On this twenty seventh day of April in the years of our LORD 1818 before the subscriber Chief Justice of the Circuit Court in said State; including said county personally appeared George Notewire aged sixty three years, resident in the Town of Great Barrington in the County of Berkshire aforesaid, in the said District _ who being by me first duly sworn according to law, doth, on his oath, make the following declaration, in order to obtain the provisions made by the late act of Congress, entitled "An act to provide for certain persons engaged in the land and naval service of the United States in the revolutionary war:" That he the said George Notewire enlisted in the winter of 1778 -9 in the State of New York in the company commanded by John Wendell of the First New York Regiment. That he continued to serve in the said corps. in the service of the United States, until the Spring of seventeen hundred and eighty three when discharged from the service in the Town of New Winder State of New York. That he was in the battle at the time of the taking of Cornwallis; - and that he is in reduced circumstances, and stands in need of the assistance of his country for support; And that he has no other evidence now in his power of his said services. Sworn to and declared before me the day and year aforesaid. John Hooker his Georey X Notewere mark I John Hooker Chief Justice of afores do certify that it appears to my satisfaction that the said George Notewere did serve in the revolutionary war, as stated in the previous declaration, against the common enemy, and I now transmit the proceedings and testimony taken and had before me, to the Secretary for the Department of War, pursuant to the directions of the aforementioned act of Congress. Woodbridge Clk ~~~~~~~~~~~~~~~~~~~~~~~~~~~ District of Massachusetts, ss: On the Twenty eighth day of June 1820; Personally appeared in open Court before the Circuit Court of Common Pleas, begun and holden at Lenox, within and for the County of Berkshire, in the Western Circuit, on the 4th Monday of June 1820, the same Court, being a Court of records for said Circuit; proceeding according to the course of common Law, with a jurisdiction, unlimited in point of amount, keeping a record of its proceedings, and having the power of fine and imprisonment, George Notewire aged sixty five years, resident of Great Barrington in the County of Berkshire aforesaid, who being first duly sworn, according to law, doth on his oath declare, that he served in the Revolutionary war as follows; that he enlisted in the company commanded by Colonel Van Scaick, in the line of the State of New York on the Continental establishment. That his original declaration is dated the twenty seventh day of April 1818 and that his pension certificate is numbered Five thousand one hundred twenty two. York who was a Private in the company commanded by Captain ---- of the Regt. commanded by Col. Van Schciack in the New York line for two years Inscribed on the Roll of Albany at the rate of 80 Dollars per annum to commence on the 4th day of March, 1836 Certificate of Pension issued the 22 day of Nov 1838 and sent to Cyrus Dana, Owego, N. Sweet, Nov 24, 1840 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ State of New York Tioga County On this thirteenth day of August AD 1838 personally appeared before the undersigned Judge of the Court of Common Pleas of Tioga County in the State of New York Huldah Noteware a resident of Newark in the county and state aforesaid aged Seventy Seven years who being first duly sworn according to Law doth on her oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress passed July 7, 1838. Entitled An act granting half pay and pensions to certain widows; That she is the widow of George Noteware who was a private Soldier in the Army of the Revolution and who was a Pensioner at the time of his death. He obtained his pension while residing at Great Barrington Massachusetts and the last payment was made to his heirs or representatives in the State of New York from which circumstance she supposes the Pension certificate was thus returned to the War Department at Washington. She further declares that she was married to the said George Noteware on the twenty second day of April Seventeen hundred and Eighty Six. That her husband the aforesaid George Noteware died on the twenty first day of August Eighteen hundred + twenty five; that she was not married to him prior to his leaving the service, but the marriage took place previous to the first day of January Seventeen hundred and ninety four viz. at the time above stated. That she has remained the widow of said George Noteware ever since the period of his decease as aforesaid. (signed) Huldah Noteware Sworn + subscribed on this day + year above written before me Elisha P. Higbi a Judge of the Court of Common Pleas of Tioga County State of New York and I certify that said Huldah Noteware is in my opinion, unable from bodily infirmity, to attend or appear in open court. I also certify that said Huldah Noteware the affiant is a person of entire credibility. Elisha P. Higbi Judge ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ I Sarah Vosburgh of Sheffield in the County of Berkshire and Commonwealth of Massachusetts, being now Sixty one years of age do depose + say: that I was acquainted with Huldah Clein (or as it may be Kline) who afterward married George Noteware. That said Huldah lived at her fathers house before + after the period of her supposed marriage. She further says that 1.d George + Huldah afterwards lived together in the town of Sheffield as husband and wife + was always repeated and understood to be husband and wife. The deponent further says that she believes the said George + Huldah were married in the year 1786 + she fixes that fact in her mind from the birth of a pair of twins children of her own mother that this Huldah nursed and further says not. Sarah Vosburgh Commonwealth of Massachusetts Berkshire SS. On the 10th day of September A.D 1838. personally appeared before me the subscriber a Justice of the Peace Sarah Vosburgh and made the solemn oath that the facts stated in the above deposition by her signed were true. I further certify that said Sarah Vosburgh is known to me to be a credible witness. N. F. Bainard Jus of the Peace ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ I Diadama Spire of Sheffield in the County of Berkshire and Commonwealth of Massachusetts being now seventy seven years of age do depose and say that she was well acquainted with Huldah Cline (or as it may be Kline) who was afterward the wife of George Notewire, that she became acquainted with her sometime in the winter of A.D 1786 at the house of Mr. Vosburgh in Salisbury Connecticut: that the sd. George Notewire and Huldah were married in the month of April A.D. 1786 as this deponent verily believes + always afterward lived together as husband and wife. This deponent will state this ground of her belief of the marriage. George Notewire was a hired man of her husband in the year 1786 and she remembers that George hired a horse of her husband to go to be married at Salisbury. On his return she heard George say that he and Huldah were married as she always understood by Esq. Camp of Salisbury. Afterward George brought his wife to my husband's house + she staid some five days + then he carried her away again. The deponent further says that she afterwards knew the sd. George + Huldah to commence house keeping in this town + continued to live together as husband and wife in this town and Great Barrington until about fourteen years ago, and raised a family of Children. About fourteen years ago this deponent called at the house of P. Notewire in G. Barrington when he his said wife were then living, and shortly afterward they removed from there to the State of New York. it was always repeated and understood that they were husband + wife. + further says not. cert. Bainard her Diadama X Spear mark ~~~~~~~~~~~~~ I Increase Sumner Town Clerk of the town of Great Barrington in the county of Berkshire and Commonwealth of Massachusetts aged thirty seven years and upwards do testify + say that on the .... of said town is the following records - Be it remembered that according to a report this day made to me by George Notewire John Notewire the son of the said George and Huldah Notewire his wife was born June the fifth in the year of our Lord one thousand seven hundred + eighty seven. That Daniel Notewire the son of the said George + Huldah was born October Eleventh in the year of our Lord one thousand seven hundred + eighty eight - That Jacob Notewire the son of the said George + Huldah was born Oct sixth in the year of our Lord one thousand seven hundred + ninety - That Rebecca Notewire the daughter of the said George + Huldah was born January first in the year of our Lord one thousand seven hundred + ninety three - That Diadama Notewire the daughter of the said George + Huldah was born October seventeenth in the year of our Lord one thousand seven hundred + ninety four - That Norton Notewire the son of the said George + Huldah was born June the fourth in the year of our Lord one thousand seven hundred + ninety seven - That Eliza Notewire the daughter of the said George + Huldah was born July sixteenth in the year of our Lord one thousand seven hundred + ninety nine - That Lorinda Notewire the daughter of the said George + Huldah was born February the ninth in the year of our Lord one thousand eight hundred + two - December eighth Eighteen hundred and twenty four Attest William C. Then the said Increase Sumner personally appeared + made oath that the above deposition by him subscribed, containing the truth, + nothing but the truth. Before me John Whiting, Just. Peace ~~~~~~~~~~~~~~~~~~~~~~~~~~~ I William Whiting of Great Barrington in the county of Berkshire Commonwealth of Massachusetts, Esqr. Being now seventy three years of age, Do testify + say that I have for many years been well acquainted with George Notewire and Huldah Notewire his wife, who moved into this town about fifty years ago, and always kept house together, and lived together as man + wife during that time in this town, and raised up a large family of Children whose names + ages are recorded in the town Book of Records of this town now kept by Increase Sumner, Esqr. as town Clerk. When the said George + Huldah first moved into this town it was ... they came from Sheffield. - After they came into this town they continued to live here till they removed, about fourteen years ago, into the State of New York. When they came into this town they were reported to be lawful man + wife + during all my acquaintance with them here till they moved away were generally reported so to be, + I never had any doubt they were lawful man + wife. When George Notewire moved out of this town he was a Pensioner of the United States as an old Soldier. William Whiting Commonwealth of Massachusetts. Berkshire .. Great Barrington Sept. 11th. 1838. Then the said William Whiting personally appeared before me that Subscriber a Justice of the Peace in + for said county of Berkshire, + made solemn oath that facts stated in the above deposition, by him subscribed, are true. And further certify that they said William Whiting is well known to me personally, + that he is a credible witness. Attd. John Whiting, Just." of the Peace, ~~~~~~~~~~~~~~~~~ Statement of Charles Benton, Town Clerk of Salisbury, CT, attesting to his failure to find the marriage record of Huldah and George Notewire in the town records, dated Sept 12, 1838 ~~~~~~~~ I Jacob Kline of Egremont county of Berkshire State of Massachusetts do certify that I am knowing to George Notewire and Huldah Kline being married by Mr. Camp Esqr of Salisbury Litchfield County State of Connecticutt in the year Seventeen hundred and eighty six and have lived as man + wife for fifty years or thereabouts -- his Samuel Newman Jacob X Kline Berkshire /s September 10th 1838 Mark there personally appeared the above named Jacob Kline and made oath that the above certificate by him subscribed is true before me Samuel Newman Justice of the Peace I hereby certify that the within named Jacob Kline is personally known to me he says he is seventy eight years old and he is considered by me to be a man of truth and veracity Egremont Sept 10th 1838 Samuel Newman Justice of the Peace ~~~~~~~~~~~~~~~~~~~~ State of New York| At Surrogates Court held Tioga County | at the village of Owego in and Surrogate's Office| for the County of Tioga on the 16th day February AD, 1841 before Nathaniel W. Davis, Esquire, Surro gate of said County - Present N. W. Davis, Surrogate At which time and place last aforesaid appeared before the Surrogate aforesaid Daniel Noteware, and who did then + there before the said Surrogate exhibit to the said Surrogate so holding said court satisfactory evidence of Huldah Noteware, deceased, that the said Will has been admitted to probate, and that said executor has taken the oath of office required by law, and letters testamentary have been issued to him also proved that the said Huldah Noteware was a pensioner of the United States made the Act of Congress passed July 7, 1838 at the rate of Eighty Dollars a year, was a resident of the County of Tioga - and died in the town of Owego in the State of New York on the first day of August in the year of Our Lord one thousand eight hundred and forty - that she left seven children surviving her and which are now living, to wit, Daniel Noteware, Jacob Noteware, Rebecca, Diadama, Eliza, Norton + Laura - That said Daniel Noteware, makes application for the amount due said children as executor. Said executor also provided the original Pension certificate which is hererunto annexed In testimony whereof I the Surrogate aforesaid have hereunto set my hand and affixed my Official of Office at Owego this 16th day February A.D., 1841.
