Dean , One of the executors named in this last will and testament of Alanson Dean late of the town of Newark in the County of Tioga deceased appeared in open court before this County Judge of the County of Tioga & made application to have the said last will and testament which relates to both real and personal estate found? & and in such application this County Judge did ascertain, by Satisfactory evidence who was the Widow, heirs, & next of Kin of the said testator & their respective residences & some of them appearing to be minors, having no General Guardian residing within the state of New York a special guardian was appointed in due form of law to take care of their interests in matter of proving the said will by an order entered for that purpose by said County Judge & said County Judge did there upon a citation in due form of law directed to said widow h---? & wife of kin & special Guardian by respective named Stating their respective places of residence requiring them to appear before said County Judge at his office in the Village of Owego of the Fifth day of April, then next ensuing to attain the probate of said will;and on the said fifth day of April AD 1851 Satisfactory evidence by affidavit was produced & presented to said County Judge of the s----? of the said citation in the mode presented by law & on that day no one appearing to oppose the probate of said will. Such procedings were thereupon had What this County Judge took the proof of said will having set forth upon the Said last mentioned day and he adjudged the said will to be a valid will of real & Personal estate & the proofs thereof to be Sufficient which said last will & testament & proofs are as follows to wit. WILL I, Alanson Dean of Owego in the County of Tioga State of New York being of sound mind & Memory & decision of making a just disposition of my property, do hereby make and declare this to be my Last will and testament as follows to wit. First, I will & Direct that all my just and legal debts & funeral charges be paid by my executive herein named. Second I give devise & bequeath unto my beloved wife Laura all my estate & Property, real & personal of which I shall die seized or which shall belong to me at the time of my decease to have and to hold the same to his and her heirs & assigned forever expecting however from what is then grown to my said wife the promissary note in the next clause hereof mentioned. Third, Whereas Harford J. Perkins has this day Given me his promissory note for two thousand dollars, payable six years from date or should he die within six years, then payable at his decease; Now Therefore it is my will & I do hereby direct that if the said Harford shall be living at the expiration of six years from the date here of then in such case my executors shall deliver up said note to him to be canceled & I do in that case give & beqeuth said note & moneys thinks? Absolutely to the said Harford; but in case the said Harford shall die within said six years leaving lawful issue surviving him I will & divide that his said note or the moneys ----d ? thereby shall be given & belong to such lawful issue; to be equally divided between them. If more than one share and share alike And in case the said Harford shall die within said six years without lawful issue surviving him, then in such case I will and direct that one half the amount of said note be given and belong to Sibyl Perkins the Mother of said Harford & the other half thereof to the brother & sisters of said Harford equally to be divided among them and share and share alike ; but should any of the said brothers or sisters die before the same Harford, leaving lawful issue then such issue as shall survive the said Harford; Shall take the share which his, her or their parent would have taken had such -------? -------?, equally to be divided between them (if more than one), share and share alike. Fourth ; I here by nominate and appoint said wife Laura & my Brother Stafford A. Dean Executives of this my last will and testament & hereby revoke all & every former will by me made. In witness whereof I have _____ set my hand and seal this eleventh day of January in the Year one thousand and eight hundred and fifty signed and sealed & dictated by the testator Alanson Dean to be His last will and testament in the presence of us who at his request in his presence & in the Presence of each other has Subscribed our names as Witness Signature Alanson Dean (seal) John M. Depositions & Testimony of the Witnessed in the manner of proving the Last Will and Testament of Alanson Dean deceased Tioga County ___ John M. Parker of the Village of Owego in the said county being duly sworn & examined before C. P. Avery ?? County Judge of said county doth depose & say that he was well acquainted with Alanson Dean lately of the town of Newark in the said county, now deceased, that he was present as a witness & did see the said Alanson Dean subscribe his name at the end of the instrument in writing now produced & shown to this deponent bearing date 11th day of January AD 1850 purporting to be the last will and Testament of the said Alanson Dean deceased The said Alanson Dean at the time of making the said subscription declare the said instrument to be his last will & testament & requested this deponent to sign his name as a witness there. There upon this deponent accordingly signed his name as a witness at the end of the same instrument in the presence of the said Alanson Dean. This deponent further says that the said Alanson Dean at the time he so executed the said instrument was a citizen of the United States of full age of Sound mind and memory in all respects competent to devise real estate & not under restraint & that this deponent saw Sabin M. Blackman then of Birkshire in said county sign the said instrument at the end there of as a witness in the presence of the said Alanson Dean & at his request Sworn this 5th day of April AD1851 AD 1851 before me Signature C.P. Avery Judge Tioga County --? Sabin M. Blackman of Monroeton, (?) Bradford County, Pennsylvania being duly sworn & examined before C. P. Avery county Judge of said county of Tioga, doth depose & say that he was well aquatinted with Alanson Dean late of the town of Newark, Tioga County now deceased that he was present as a witness & did see the said Alanson Dean subscribe his name at the end of the instrument in writing now produced & shown to this deponent bearing date of the 11th day of January AD 1851 purporting to be the last will and testament of the said Alanson Dean deceased and that instrument to be his last will & testament & requested this deponent to sign his name as a witness there to There upon this deponent accordingly signed his name as a witness at the end of said instrument in the presence of the said Alanson Dean. This deponent further says that the said Alanson Dean at the time he so executed the said instrument was a citizen of the United States, of full age of sound mind & memory, in all respects competent to devise real estate & under no restraint & that this deponent saw John M.Perkins of Owego, Tioga County, sign the said instrument at the end there of as a witness in the presence of the said Alanson Dean & at his request.
