Will
In the name of God amen, I Joel Phelps of the town of Candor, County of Tioga, 
State of New York, being of sound and disposing mind and memory and 
understanding...do make and declare this to be my last will and testament as 
follows, to wit, viz: 

First - I will and direct that all my just and lawful debts and funeral
expenses be paid by my executrix hereinafter named.

Second - I give and bequeath to my beloved wife Harriet H. all my household 
furniture, also all my personal estate of every description for the sole
purpose of maintaining her and my two chidren viz. Stephen D. and Enos J.,
having the fullest confidence that she will do for them all that her
circumstances will permit. I also give her one third of my real estate
consisting of that share of the farm on which I now live and willed to me by
my father.

Third - I give and bequeath to my two children Stephen D. and Enos J. the 
remaining two thirds of my real estate for them to have to to hold jointly and 
in case of the death of either, the surviving one to have the shares designed 
for both.

Fourth - I do hereby nominate and appoint my beloved wife Harriet H. the sole 
executrix of this my last will and testament, giving her full power and 
authority to [illegible] and dispose of all my real and personal property and
it is my wish and desire that she purchase real estate with the assets thereof
and when so purchased my above named children shall be entitled to two thirds,
the same as in the real estate I now hold. I also authorize my said wife
Harriet to give all the necessary title to the above named real estate that I
can give.

Fifth - The above named legacies to my children are to be deeded and given to 
them when they shall arrive to the age of twenty one years. In the fourth item 
it is intended and designed that only the rest of my real estate shall be paid 
for landed property, not the personal.

In witness hereof, I Joel Phelps of Candor have this twenty eighth day of 
February one thousand eight hundred and forty four hereby declare this to be
my last will and testament; Joel Phelps L.S.

Signed, sealed and delivered in by the testator Joel Phelps to be his last
will and testament in the presence of us at his request and in the presence of
each other as witnesses:
Asa Hall of Tioga, Tioga County
Moses Darling of Candor, Tioga County
Bradford Phelps of Candor, Tioga County.
