R. Wright, deceased Be it remembered, that heretofore, to wit, on the 17th day of December in the year of our Lord, one thousand, eight hundred and eighty one, Hiram L Knapp, the Executor named in the Last Will and Testament of John S R Wright, late of the town of Nichols in the County of Tioga deceased, appeared in open Court, before the Surrogate of the County of Tioga, and made application to have the said Last Will and Testament of John S R Wright, which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain, by satisfactory evidence, who were the heirs at law and next of kin of the said testator and their respective residences and said Surrogate did thereupon issue a Citation, in due form of law, directed to the heirs at law and next of kin of the said deceased, by their respective names, stating their respective places of residence requiring them to appear before said Surrogate, at his office in the village of Owego, in said County, on the 7th day of January, 1882, to attend the Probate of said Will. And afterwards, to wit, on the 7th day of January, A. D. 1882, satisfactory evidence, by affidavit, was produced and presented to said Surrogate of the due service of said Citation, in the mode prescribed by law, and on that day no one appearing to oppose the probate of such Will, such proceedings were thereupon had, in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 7th day of January A. D. 1882, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament and proofs, are as follows, that is to say: Will In the Name of God, Amen I, John S R Wright, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament, that is to say: First. After all my lawful debts are paid and discharged, I give and bequeath unto Hiram Knapp & Charles L. White as executors of this my last will and testament One hundred & fifty dollars to be used for the payment of a monument & if necessary not to exceed twenty five dollars additional. II. I give and bequeath unto my sister Ruth Jane Briggs the sum of Two Hundred Dollars. III. I give and bequeath unto my brother Hollister A. Wright the sum of eighty five dollars. IV. I give and bequeath unto Caleb Wright the sum of Fifteen dollars & the balance of my estate both real & personal, if any, after paying all debts & expenses to be divided pro rata as above between Ruth Jane Briggs, Hollister A. Wright & Caleb Wright. V. I hereby give unto Hiram Knapp & Charles L. White, my executors, full power to sell & convey all real estate of which I may be vested in at my decease. Likewise, I make, constitute and appoint Hiram Knapp & Charles L. White to be executors of this my last Will and Testament hereby revoking all former Wills by me made. At a Surrogate's Court held in and for the County of Tioga at the Surrogates Office in the Village of Owego on the 7th day of January A.D. 1882 Present Hon. Charles A Clark, Surrogate In the matter of proving the last will and testament of John S. R. Wright, deceased Satisfactory proof having made and filed of the due service of the citation heretofore issued in this matter requiring the proper persons to appear in this Court on the 7th day of January AD 1882 at ten o'clock in the forenoon of that day and attend the probate of the Last Will and Testament of John S. R. Wright late of the town of Nichols in the county of Tioga and State of New York, deceased, and no one appearing to oppose the probate of said will and Hiram L. Knapp the executor and Henry White and Lewis Jones the attesting witnesses having appeared in support of the proof of said will and H. Austin Clark Esq., the duly appointed Special Guardian of Ernest Briggs and Elmer Briggs, infant heirs at law and next of kin of the said deceased and after hearing the proofs and allegations of the persons appearing as aforesaid and duly deliberating thereon and it appearing that said Will was duly executed that the testator at the time of executing it was in all respects competent to make a will and devise real estate and not under restraint; and the Executor having given a bond with sufficient sureties as required by the Statute in such case made and provided. It is Ordered, Adjudged and Decreed, that said Will be and the same is hereby admitted to probate as a valid will of real and personal estate and that it be recorded accordingly. signed) C. A. Clark Surrogate SURROGATE'S COURT In the matter of proving the last Will and Testament of John S. R. Wright, deceased Tioga County, ss. Henry White and Lewis Jones, being duly sworn in open Court, upon their several corporeal oaths, each for himself doth depose and say, that he is a subscribing witness to the Last Will and Testament of John S. R. Wright, late of the town of Nichols in the county of Tioga and State of New York, deceased. And these deponents do further say, that the said John S. R. Wright, deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument, in writing, which is now here shown to these deponents, and which purports to be the Last Will and Testament of the said deceased, and which bears date on the 24th day of November one thousand, eight hundred and (eighty one) (A line failed to copy. It is assumed that this is correct. JSD) That the said deceased did, at the time of subscribing his name to the said instrument, as aforesaid, declare the same to be his Last Will and Testament, and these deponents did thereupon subscribe their own respective names at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in his presence, and in the presence of each other. That the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United States; that he appeared to be, and the deponents believe he was, of sound mind, memory and understanding, and not under any restraint, and, as deponents verily believe, in all respects competent to devise real estate. That each of these deponents saw the other sign his name to said instrument, in the presence of said deceased. It appearing, upon the proofs duly taken in respect to the Last Will and Testament of John S. R. Wright late of the town of Nichols in the County of Tioga and State of New York, deceased, that the said Will was duly executed, and that the said John S. R. Wright at the time he executed the same, was, in all respects, competent to devise real estate, and not under restraint. The said Last Will and Testament and the proofs and examinations, are hereby recorded, signed and certified by me, pursuant to the provisions of the Revised Statutes, this 7th day of January A.
