Laning PAGE 281 Be it remembered, that heretofore on the 24th day of May in the year 1897, JULIETT LANING and JULIA E. COOK, the executrix and devisee and legatee named in the Last Will and Testament of JOHN C. LANING, late of the town of Owego, in Tioga County, now deceased, appeared in open Court, before the Surrogate of Tioga County and filed their petition, praying that such instrument be admitted to probate as the Last Will and Testament of said deceased. And it appearing from said petition that all parties interested in said Will are of full age and sane mind, and no one appearing in opposition thereto, and is appearing that said petitioners are the only persons interested in said estate, thereby rendering the issue and service of a citation in that matter unnecessary. It is ordered that a citation in this matter be, and the same is, hereby dispensed with that, and that the proofs of such Will be taken forthwith. And thereupon, to wit, on this 24th day of May, 1897, the parties appeared as aforesaid and by Martin S. Lynch, Esq., their attorney; Martin S. Lynch and Fred J. Davis appeared and testified for proponents in support of said will as attesting witnesses to the execution thereof; Juliett Laning, the executrix therein named having taken and filed the statutory oath for executrix. Last Will and Testament I, JOHN C. LANING of Owego, Tioga County, NY do make, ordain, publish and declare this my Last Will and Testament, in manner and form following that is to say: First, I direct the payment of my just debts, if any, and my funeral expenses. Second. I give, devise and bequeath to my beloved wife Juliet Laning all my real estate, lands, tenements and hereditaments and also my personal property, goods, chattels, and credits of every name and nature and wheresoever situate, to have and to hold the same to her own exclusive use and benefit, for and during the term and continuance of her natural life and no longer. Third. From and after the decease of my said wife Juliet Laning I give, devise and bequeath to my daughter Julia E. Cook all of my said real estate, lands, tenements and hereditaments and also all my said personal property, goods, chattels and credits of every name and nature and wheresoever situate to have and to hold the same to herself, her heirs, executors, administrators and assigns forever, absolutely and in fee simple. Likewise, I make, constitute and appoint my said wife Juliet Laning to be executrix of this my Last Will and Testament hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto subscribed my name and fixed my seal, the 30th day of November in the year of our Lord, one thousand eight hundred and ninety-two. John C.
