Fhl Film #811757 Tioga co NY Will Book Vol. 23 page 357 Written: April 20, 1893 Recorded: February 7, 1898 Last will and testament and codicil of Asa Phelps 7 February 1898, Sheldon Phelps, the executor and Mary E. Little a person interested and named in the last will and testament of Asa Phelps, late of the Town of Candor, the County of Tioga, now deceased, appeared in open court, etc... and it also apearing that the petitioners are the only persons interested in this matter, etc... Will I, Asa Phelps of the town of Candor, Tioga County, New York do make, publish and declare this my last will and testament in manner and form following, that is to say: First - I give, devise and bequeath unto my son Sheldon Phelps all my property, both real and personal of every kind nature and description whatsoever, excepting only household furniture, money and obligations and secuirties for the payment of money, subject however to the payment to my daughter Mary E. Little of the sum of fifteen hundred dollars, which said sum of fifteen hundred dollars I hereby give and bequeath unto my said daughter Mary E. Little to be paid to her by my said son within one year after my decease, and do hereby expressly charge the payment thereof upon the property hereinbefore given to my said son. Second - I give, devise and bequeath all the rest and residue of my property, to wit, household furniture, money and obligations and securities for the payment of money to my said son and daughter equally to be divided between them share and share alike. Lastly - I make, constitute and appoint my said son Sheldon Phelps executor of this my will. Witness my hand and seal this twentieth day of April 1893 Asa Phelps L.S. Attesting witnesses: George F. Andrews, Owego, NY and Frank Beck, Owego, NY I, Asa Phelps of the town of Candor in the County of Tioga, and State of New York, having heretofore and on the 20th day of April, 1893, made and executed my last will and testament which is preceding this codicil on the same sheet, now I do make and publish this as and for and hereby declare the same to be a codicil to my said last will and testament in manner and form following that is to say: I hereby revoke all of the gifts, legacies and provisions of every kind in favor of my daughter Mary E. Little in my said will contained, and I do hereby give and bequeath unto my said daughter the sum of fifteen hundred dollars and charge the payment of the same upon any and all real estate which I shall own at the time of my death, and I do hereby give, devise and bequeath all the rest and residue of my property both real and personal (that is all my property subject to the payment of said sum of fifteen hundred dollars) unto my son Sheldon Phelps to be his absolutely forever.
