P. Schoonmaker The People of the State of New York by the grace of Free and Independent To all to whom these present shall as may concern - greetings Know ye that at the town of Elmira, within the county of Tioga the fourteenth day of February in the year of our Lord one thousand, eight hundred and seventeen before Robert Laurence, Esquire surrogate of the county of Tioga afore said the last will and testament of Moses D. P. Schoonmaker, late of the town of Caroline in the said county, deceased. ( a copy of which is herein annexed) was proved and is now approved by us, and allowed and the said deceased having whilst he lived and at the time of his death, goods, chattly, and credits , within this state means whereof this proving and registering the said Will and the granting administration of all and singular the goods, chattly and credits and also the attesting, allowing and the final discharging the accounts thereof doth belong unto us the administration of all and singular the goods, chattly, and credits of the said deceased any way concerning his will is granted unto Jemima Schoonmaker, Executrix in said will named the said Jemina Schoonmaker being by me first duly sworn will and faithfully to administer the same and also to render a just and true account administration when those unto legally request. In testimony where of we have caused the seal of office of our said surrogate to be herein affixed , witness Robert Laurence, Esquire surrogate for the said county at Elmira in said county the fourteenth day of February in the year of our Lord One Thousand Eight Hundred and Seventeen and of the Independence of the United States the Forty first. I, Moses Depue Schoonmaker of the Town of Caroline, county of Tioga, State of New York being sick in body but perfectly sound in mind and memory do make this my last will and testament. I do hereby appoint my beloved wife Jemina Shoemaker Executrix, my brother Simion D. W. Shoemaker, and my friend John James Spoed (sp?) Executors to this my will. It is my will and desire that all my just debts be paid by my Executrix or Executors as soon as circumstances will admit ----- It is my will and desire that all my property, both real and personal shall be at the disposal of my wife for the maintenance of herself & my children during her life as widowhood ---- at her death or in case she should marry again it is my will that all of my property be sold & the money when collected to be equally divided between all my children. It is my will & desire that any part or the whole of my land as may be left, and a deed from my Executors & Executrix or the acting part of them, be considered good in law. In witness whereof I have here unto set my hand and affixed my seal this 10th day of Sept. 1815. It is my will and desire that my black man belong to my son Jacob De Witt Schoonmaker to be at his disposal after my death, and that he have his equal share of the rest of my property when divided. Schoonmaker Jr. Toiga County Surrogate's Office Be it to me inbased that on the fourteenth day of February in the year of our Lord One Thousand Eight Hundred and Seventeen personally appeared before me Robert Laurence, Esquire Surrogate of the county of Tioga, Jacobus Quick Jr. and Jacob D. W. Schoonmaker, Jr. Two of the subscribing witnesses to the forgoing instrument of writing purporting to be the last will and testament of Moses D. P. Schoonmaker, late of the town of Caroline in said county Deceased, who being by me duly sworn did dispose and say that they were present and did see the said moses D. P. Schoonmaker sign and date said instrument of writing and at the same time heard him say, publish and pronounce the same to be his last will and testament in the presence also of Abraham Haasman, the other subscribing witness to the said instrument and that they together with the said abraham Haasman subscribed their names as witness thereto in the presence of the testator and of each other and that at the time of the execution thereof the said testator appeared to them to be of sound mind and memory.
