Last Will and Testament I, Ada Bell Campbell of the City of Ithaca, in the County of Tompkins and State of New York, being of sound mind and memory, do make, publish and declare this my last Will and Testament, in manner following, that is to say: First.- I direct that all my just debts and funeral expenses be paid. Second.- All the rest, residue and remainder of my Estate, Real, personal and mixed, wheresoever situate, of which I may die seized or possessed, or to which I may be entitled at the time of my decease, I give, devise and bequeath to my beloved husband, John C. Campbell, to have and to hold the same to him, absolutely and for ever. It is my wish and desire that immediately upon my decease, that my husband make his Will and by that Instrument that he Will the property at his decease to our two children, equally, share and share alike. Third. - I authorize and empower my Executor hereinafter named, to sell and dispose of all or any of my Real Estate of which I shall die seized or possessed, at public or private sale, at such times and on such terms and conditions as he shall deem meet or proper and to execute, acknowledge and deliver all proper writings, deeds of conveyance and transfers therefor, but is my desire that no such transfer shall be made unless in the judgement of my Executor this becomes necessary. Lastly, I hereby appoint my husband, John C. Campbell executor of this, my last Will and Testament; hereby revoking all former wills by me made. In Winess Whereof, I have hereunto subscribed my name the first day of february in the year One thousand nine hundred and sixteen. Campbell of the City of Ithaca in the County of Tompkins, and State of New York, respectfully shows: That ADA BELL CAMPBELL late of the City of Ithaca in the County of Tompkins, died on the 13th day of January, 1918, leaving a Last Will and Testament dated the 1st day of February, 1916 which is signed at the end thereof by the said testatrix and also by Arthur G. Adams and Alfred L. Ham as subscribing witnesses thereto. That the said decedent was a citizen of the United States, and at the time of her death was a resident of the City of Ithaca County of Tompkins, and State of New York. That your petitioner is the Executor named in the Will and Testament. That the said Will and Testament relates to both real and personal property, and the value of the personal property does not exceed the sum of EIGHT HUNDRED dollars and the value of the real property does not exceed the sum of FOUR THOUSAND dollars, as your petitioner is informed and believing. That the said decedent left her surviving John C. Campbell, (her husband), who resides at the City of Ithaca in the County of Tompkins and State of New York. Your petitioner further states that the only heirs at law and next of kin, of said decedent, and their relationship to said decedent, and their respective places of residence and post-office addresses are as set opposite their names respectively, as follows: John C. Campbell, a husband residing at Ithaca, N.Y. Matie C. Morgan, a daughter residing at Morris Run, Pa. E. Ray Campbell, a son residing at Ithaca, N.Y. That the following named persons are the only persons in said will as legatees or devisees and are all the persons in being who take an interest in the personal or real property of said decedent under said Will, as your petitioner is informed and believes; and their relationship to said decedent and their respective places of residence and post-office addresses are as set opposite their names respectively, as follows: John C. Campbell a husband residing at Ithaca, N.Y. Matie C. Morgan a daughter residing at Morris Run, Pa. E. Ray Campbell a son residing at Ithaca, N.Y. That the Executors and Trustees named or described in said Will, and their respective places of residence and post-office addresses, are as follows: John C. Campbell, husband residing at Ithaca, N.Y. That as your petitioner is informed and believes, all of the foregoing named persons are of full age and sound mind, except the following, who are infants of the ages set opposite their respective names, and such of them as are under fourteen years of age reside with the persons as hereinafter stated, and the names and residence of their father, mother or guardian, are as hereinafter stated, to wit: No Exceptions That no petition for the probate of said Will, or for the Letters of Administration on the estate, has been heretofore filed in this or any other Surrogate's Court of the State. Your petitioner further prays that a citation issue to the above named widow (or husband), heirs-at-law and next of kin to attend the probate thereof, and that the said last Will and Testament may be proved as a Will of real and personal property, and that letters Testamentary may be issued thereon to the Executor who may qualify thereunder, and that your petitioner have such other or further order or decree as may be proper.
