He died without leaving a will. PETITION FOR LETTERS OF ADMINISTRATION State of New York, Tompkins Co. Surrogates Court TO THE SURROGATE OF THE COUNTY OF TOMPKINS - The Petition of Mrs. Sally Berry Widow of Luther Berry deceased, respectfully represents, that the said Luther Berry deceased, died a natural death on or about the eighth day of March in the year of our Lord one thousand eight hundred and sixty five in the town of Groton in the county of Tompkins without having a last will and testament as far as your petitioner has been able to discover, or has heard, knows or believes. That at or immediately previous to his death, the said deceased was an inhabitant of the county of Tompkins; by means of which your petitioner has been imformed and believes the Surrogate of the said county of Tompkins has sole and exclusive power to grant letters of administration of the goods, chattels and credits of the deceased. That the said deceased has left a widow, your petitioner, and eight children. towit: S P Berry of Quincy, Wis; Lemuel Berry of Adrian, Mich; Eliza Bangs wife of Samuel Bangs of Summer Hill, NY; D C Berry of Portage, Wis; Melinda Backus wife of Brainard Backus of Groton, NY; Buel Berry of Groton, NY; Irena J Morton wife of David Morton of Fountain, Wis; & Arita S Berry of Groton, NY. That the said Luther Berry deceased left no real estate at his decease being all the kindred and hiers, or legal representatives of the deceased, who are entitled to an interest in his estate, with their places of residence, as far as can be ascertained by your petitioner. That all goods, chattels, credits, personal estate, and effects, of which the said deceased died, possessed, owned or was entitled to, do not exceed in value the sum of three hundred dollars. That your petitioner is desirous that administration should be duly granted upon the estate of the said deceased. Your petitioner therefore prays that letters of administration of the goods, chattels and credits of the said deceased may be granted to Sally Berry and Buel Berry And your petitioner will ever pray, &c Dated this 29th day of July 1865 Sally Berry Tompkins Co SS: I, Sally Berry the above petitioner being duly sworn say that the matters set forth in the preceeding petition are true.
