Present Arthur S. Johnson, Surrogate. Thomas Bishop, Daniel Platt and John George, executors named in the last Will & Testament of Garret Lambertson deceased, late of the Town of Dryden in said County, deceased appeared for the purpose of proving & having the said Will recorded according to law & made satisfactory proof that notice of this application had been served according to law on all the heirs of said deceased. An instrument purporting to be the last Will & Testament of Garret Lambertson, bearing date the sixth day of May in the year 1839, was produced in court & shown to each of the persons sworn to witnesses as hereinafter mentioned. Which said Will follows are these words to wit. The last Will & Testament of Garret Lambertson of the town of Dryden County of Tompkins. I Garret Lambertson of Town & County afforesaid [sic] considering the uncertainty of this mortal life and being of sound disposing mind & memory, blessed be Almighty God for the same, do make & publish this my Last Will & Testament in words following to wit - First_ I order & direct that my executors here in after named pay all my just debts & funeral charges out of the first money coming into their hands after my decease- Secondly_ I order & direct that as soon as may be convenient after my decease, that my said executors divide the whole of my real estate, in the said Town of Dryden or else where of which I die seized among my beloved Wife, Nancy & my sons John & Daniel & my daughters, Julia Ann, Sarah, Margaret Lovine, Mary, Lydia, Huldah and Ruth, as follows, to wit one third parts thereof to my said wife Nancy in lieu of dower & the Residue among my said sons & daughters above named equal shares. Quantity, quality relatively considered with the exception of my five youngest daughters, Margaret Lovine, Mary, Lydia, Huldah and Ruth whose shares are to be made in said divisions worth one hundred & fifty dollars, each more than the shares of John, Daniel, Julia Ann & Sarah each & if it shall appear to my said executors to be more advantageous to my said estate or for the benefit of my said Sons & Daughters above named to dispose of my said Real Estate, I hereby empower & direct my said Executors to dispose of said Real Estate at Publick [sic] Auction or other wise in whole or in parts at such time or times and on such terms as to them shall seem advantageous & to my said Estate & to place one third part of the money arising from said, shall at interest accrued by bond & mortgage or otherwise as they may think best & to pay the interest arising therefrom into the hands of my said wife, in lieu of dower, to be disposed of as she may think best. And out of the remaining two thirds I direct that my daughters, Margaret Lovine, Mary, Lydia, Huldah and Ruth be paid one hundred & fifty dollars each & that the residue be equally divided among my sons & daughters. John Lambertson, Daniel Lambertson, Julia Ann Platt, Sarah Harned, Margaret Lovine Lambertson, Mary Lambertson, Lydia Lambertson, Huldah Lambertson & Ruth Lambertson. Thirdly, I order & direct that my said executors dispose of my personal property as soon as convenient after my decease at Publick [sic] Auction, & that they divide the proceeds arising from the sales of the same, after the payment of my just debts, & funeral charges as above, among my wife Nancy, Julia Ann Platt, Jane Shaver, John Lambertson, Sarah Harned, Eliza Ann Gray, Esther Cuiatt (sp), Margaret Lovine Lambertson, Mary Lambertson, Lydia Lambertson, Daniel Lambertson, Huldah Lambertson & Ruth Lambertson. Lastly: I nominate & appoint my Trusty Friends, Thomas Bishop, of the town of Lansing & John George & Daniel Platt of the Town of Dryden, Executors, of this my last said Will & Testament, hereby revoking all former Wills by me made. In testimony whereof I have hereunto set my hand & seal this sixth day of May in the year of our Lord, one thousand and eight hundred & thirty nine________ Garrett [sic] X (his mark) Lambertson, L.S. Signed, sealed, published and declared by the above named Garret Lambertson as and for his last Will and Testament in the presence of us who have hereunto subscribed our names in the presence of the Testator & in the presence of each other. Thompson Parsons of the town of Lansing, County of Tompkins, Newton Bishop of the town of Lansing, County of Tompkins, Thomas Parson of the Town of Lansing ____ Thomas Bishop of the Town of Lansing “” Thompson Parsons of the town of Lansing in the county of Tompkins being first duly sworn, deposeth and saith that he was accquainted [sic] with the above mentioned Garret Lambertson deceased, in his life time, that he saw the said Garret Lambertson, deceased subscribe the instrument now shown to this deponent, perporting [sic] to be the last Will & Testament of the said Garret Lambertson as above described; that he heard the said Garret Lambertson declare the same to be his last Will & Testament; that this deponent subscribed his name as a witness thereto in the presence & at the request of the said Garret Lambertson, that the said Garret Lambertson was at the time in the opinion and belief of this deponent of sound mind & memory, not under any restraint; & that he was about sixty years of age, that he died on or about the ninth day of August in the year 1839 - and was a resident of the Town of Dryden, in the county of Tompkins at the time of his death. Thompson Parsons-[signature] Newton Bishop of the town of Lansing in the County of Tompkins being first duly sworn deposeth and saith that he was acquainted with the above mentioned Garret Lambertson deceased in his life time; that he saw the said Garret Lambertson deceased, subscribed the instrument now shown to this deponent perporting [sic] to be the last Will and Testament of the said Garret Lambertson & above described that he heard the said Garret Lambertson declare the same to be his last Will & Testament, that this deponent subscribed his name as a witness thereto in the presence, and at the request of the said Garret Lambertson, that the said Garret Lambertson was at the time in the opinion & belief of this deponent of sound mind & memory & not under any restraint & that he was about sixty years of age, that he died in or about the ninth day of August in the year 1839 & was a resident of the Town of Dryden in the County of Tompkins at the time of his death. Newton Bishop -[signature] Thomas Parsons of of [sic] the town of Lansing in the County of Tompkins being first duly sworn deposeth & saith that he was acquainted with the above mentioned Garret Lambertson deceased in his life time, that he saw the said Garret Lambertson deceased subscribe the instrument now shown to this deponent purporting to be the last Will &Testament of the said Garret Lambertson & above described that he heard the said Garret Lambertson declare the same to be his last Will & Testament that this deponent subscribed his name as a witness thereto in the presence and at the request of the said Garret Lambertson that the said Garret Lambertson was at the time in the opinion & belief of this deponent of sound mind & memory & not under any restraint & that he was about sixty years of age that he died on or about the ninth day of August in the year 1839 - & was a resident of the town of Lansing Dryden in the County of Tompkins at the time of this death. Thomas Parsons -[signature] Thomas Bishop being duly sworn says the within described will of Garret Lambertson deceased was put in his hands for safe keeping by the said Garret Lambertson and that said Will remained in his custody until after the decease of the Testator, when he delivered said Will to the Surrogate to be proved & recorded & that said Will was not altered in any respect while in his possession. Sworn before me. Thomas Bishop [signature] Arthur S. Johnson Surrogate - The foregoing proofs of examination taken before me the Surrogate aforesaid at the time & place first mentioned & the depositions of the respective witnesses were by them respectively subscribed after having been carefully read over to them. And I the said surrogate being satisfied upon said proof taken that the said Will was duly executed; that the said testator at the time of executing the same was in all respects competent to devise real estate & not under restraint do therefore allow the said Will, proofs and examinations to be recorded.
