All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm *********************************************************************** Tompkins co NY Will Book Vol. F page 294 Written: 25 Aug 1848 Probated: 29 Jun 1849 Ithaca, Tompkins County, New York I, Ichabod BEARDSLEY of the town of Lansing County of Tompkins and the State of New York considering the uncertainity of this mortal life and being of sound mind and memory blessed to almighty God for the same do make and publish this my last will and testament in manner and form following that is to say: First, after my decease my whole estate real and personal is to be at the disposal of my executors hereafter named to dispose of as they shall see fit and for the best advantage of the heirs either at public or private sale within two years. The accts of land property both real and personal after repaying the expenses and paying all my debts shall be equally divided among my five children (with the exception of Noah who is to him three hundred dollars more than his equal division.) Lorama, Noah, Ransom, Theodoria and Jonathan. 2nd: I do hereby constitute and appoint my trusty friends Noah Beardsley and Benoni Brown executors of this my last will and testament hereby revoking all other wills by me made. The witness whereof I have hitherto sat my hand and seal this the twenty fifty day of August one thousand eight hundred and forty eight. Ichabod Beardsley LS The within instrument consisting of one half sheet now here subscribed by Ichabod Beardsley the testator in the presence of each of and was at the same time declared by him to be his last will and testament and was at his request sign our names hereto as attaching witnesses: Abram Ozmun 2nd; Roswell Beardsley Abram Ozmun 2nd of the Town of Lansing, in the County of Tompkins being first duly sworn deposeth and saith that he was acquainted with the above named Ichabod Beardsley deceased in his life time that he saw the said Ichabod Beardsley deceased enscribe at the end thereof the instrument now thence to this deponent purporting the last will & testament of the said Ichabod Beardsley & above described that he heard the said Ichabod Beardsley declare the same to be his last will & testament. That this deponent inscribed his name as a withness thereto in the presence & at the request of the said Ichabod Beardsley was at the time in the opinion and with belief of this deponent of sound mind & memory & not under any restraint & that he was about eighty years of age. That he died on or about the 27th day of April in the year 1849 and was a resident of the Town of Lansing in the County of Tompkins at the time of his death. Abram Ozmun 2nd Subscribed examined this 29th day of June 1849 before me Alfred Wells, County Judge. Roswell Beardsley of the Town of Lansing in the County of Tompkins being first duly sworn deposith and saith that he was acquainted with the above mentioned Ichabod Beardsley deceased in his life time, that he saw the said Ichabod Beardsley deceased enscribed at the end and thereof the instrument now thence & this deponent purported to be the last will & testament of the said Ichabod Beardsley & above deceased that he heard the said Ichabod Beardsley declared the same to be his last will & testament - that this depondent inscribed his name and intrussed (sic) thinks in the presences & at the request of the said Ichabod Beardsley that the said Ichabod Beardsley was at the time in the opinion & belief of this deponent of sound mind & memory & not under any restraint, and he was about 80 years of age that he died in or about the latter part of April in the year 1849 and was a resident of the Town of Lansing in the County of Tompkins at the time of his death. R Beardsley Subscribed, sworn examined this 29th day of June 1849 before me Alfred Wells, County Judge. John B. Hardenburg being duly sworn deposes & says that he resides in the Town of Lansing Tompkins County that he was acquainted with Ichabod Beardsley deceased in his life time. That after the will of the said Ichabod Beardsley was executed he kept the same in his own custody until after his death when it was found in his coat pocket. That deponent took the will & kept the same until he handed it to Benoni Bown one of executors named in the will. That deponent never read the will but delivered it to Mr. Brown in the same condition that deponent received. John B. Hardenburgh Subscribed, sworn examined this 29th of June 1849 before me Alfred Wells County Judge. Benoni Brown being first duly sworn deposes & says that he resides in the Town of Lansing. That he received the last will and testament of Ichabod Beaardsley from John B. Hardenburgh. That he delivered the same to the County Judge for probate & that the will is in the same condition now as when it was first came to deponents hands. Benoni Brown Subscribed sworn examined this 29th day of June 1849 before me Alfred Wells County Judge. The foregoing proofs & examinations taken before me the County Judge aforesaid at the time & place first mentioned & the depositions of the respective witnesses and by them repectively subscribed after having carefully read one of them. And I the said County Judge being satisfied upon said proof taken that the said will was duly executed that the said testator at the time of executing the same was in all respects competent to divide real estate & not under restraint - do therefore allow said will, proof & examinations to be recorded. And the said Benoni Brown having taken & subscribed the oath required by law. It is ordered pursuant to the direction of the said will that Letters Testamentary to ---- to him.
