J page 117 Written: January 24 1866 Recorded: March 26 1866 At a Surrogate's Court, held for the County of Tompkins, at the office of the County Judge of the said County, in the Village of Ithaca, on the twenty sixth day of March in the year 1866 Present, H S Wallridge County Judge. An Instrument, purporting to be the last Will and Testament of George Tucker bearing date the fourth day of December in the year 1865 was produced in court, and shown to each of the persons sworn as witnesses, as hereinafter mentioned. Andrew Stout of the town of Groton in the county of Tompkins being first duly sworn, deposeth and saith, that he was acquainted with the above mentioned George Tucker deceased, in his life-time; that he saw the said George Tucker deceased, subscribe at the end thereof the instrument now shown to this deponent, purporting to be the last Will and Testament of the said George Tucker and above described; that he heard the said George Tucker declare the same to be his last Will and Testament; that this deponent subscribed his name as a witness thereto in the presence and at the request of the said George Tucker[;] that the said George Tucker was at the time in the opinion and belief of this deponent, of sound mind and memory, and not under any restraint; and that he was about sixty two years of age; that he died on or about the 24 th day of January in the year 1866 and was a resident of the town of Dryden in the county of Tompkins at the time of his death. Andrew Stout Sworn and Examined Before H S Wallridge Co Judge Sylvester Hile of the town of Dryden in the county of Tompkins being first duly sworn, deposeth and saith, that he was acquainted with the above mentioned George Tucker deceased, in his life-time; that he saw the said George Tucker deceased, subscribe at the end thereof the instrument now shown to this deponent, purporting to be the last Will and Testament of the said George Tucker and above described; that he heard the said George Tucker declare the same to be his last Will and Testament; that this deponent subscribed his name as a witness thereto in the presence and at the request of the said George Tucker; that the said George Tucker was at the time, in the opinion and belief of this deponent, of sound mind and memory, and not under any restraint; and that he was about sixty two years of age; that he died on or about the 24 th day of January in the year 1866, and was a resident of the town of Dryden in the county of Tompkins at the time of his death. Sylvester Hile Sworn and Examined Before H S Wallridge Co Judge Richard Lansing of the town of Groton being first duly sworn says that he drew the said last Will and Testament of the said George Tucker deceased and on inspecting it says that it is now in the same condition that it was at the time it was executed. R Lansing Sworn and Examined Before H S Wallridge Co Judge Which said last Will and Testament is in the words and figures following, to wit: In the name of God Amen. I George Tucker of the town of Dryden in the County of Tompkins and the State of New York being of Sound Mind and Memory and Considering the uncertainty of this frail and Transitory life. Do therefore make ordain and publish and declare this to be my last Will and Testament, that is to say-- After All my lawful debts are paid and discharged, the residue of my estate real and personal I give bequeath and dispose of as follows to wit: To my well beloved wife Mary Ann Tucker one third of my real estate in lieu of Dower and all other legal claims and the use of one third of my personal estate during her life -- and at her death to be equally divided among my children Mary Ann Tucker, George S Tucker, Ervilla Tucker and Myron H Tucker or their heirs. To my son George S Tucker one third of the remaining two thirds of my real estate and one third of the remaining two thirds of my personal estate. To my son Myron H Tucker one third of the remaining two thirds of my real estate and one third of the remaining two thirds of my personal estate. To my Daughter Mary Ann Tucker one half of the remaining third of the remaining two thirds of my real estate and one half of the remaining third of the remaining two thirds of my personal estate. To my daughter Ervilla Tucker one half of the remaining third of the remaining two thirds of my real estate and one half of the remaining third of the remaining two thirds of my personal estate. To my executors one dollar and fifty cents each per day for all necessary times spent in settling my estate in lieu of percentage. The above legacies to be paid to each of my sons when they arrive at the age of twenty one years and to each of my daughters when they arrive at the age of eighteen years respectively and in case of their death to their heirs. I hereby authorize my executors to sell all my real estate and invest the avails on freehold security or otherwise at their discretion. I hereby appoint my executors General Guardians of Mary Ann Tucker[,]George S Tucker[,] Ervilla Tucker & Myron H Tucker. Likewise I make constitute and appoint my said beloved wife Mary Ann Tucker Executrix and Richard Lansing Executor of this my last Will and Testament hereby revoking all former Wills by me Made.
