Present - MARCUS LYON - County Judge and Surrogate In the matter of Proving the Last Will and Testament of ANDREW W. REED - Deceased AN INSTRUMENT, purporting to be the last Will and Testament of ANDREW W. REED, bearing the date the 6th day of June 1872 was produced in open Court, and shown to each of the persons sworn as witnesses, as hereinafter mentioned: TOMPKINS COUNTY, ss: [signed] JAY B. KLINE and being first duly and severably sworn, in open Court, and being severably examined, upon his corporeal oath for himself doth depose and say, that he is a subscribing witness to the last Will and Testament of ANDREW W. REED late of the Town of Ithaca in the County of Tompkins, and State of New York, deceased; that the said ANDREW W. REED deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument in writing, which is now here shown to this deponent, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 6th day of June 1872. That the said deceased did, at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last Will and Testament and this deponent did thereupon subscribe his own name at the end of said instrument, as an attesting witness to the execution thereof, at the request of the said deceased, and in his presence: That the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United States; that he appeared to be, and deponent believes he was of sound mind, memory and understanding, and not under any restraint, and as deponent verily believes, in all respects competent to devise real estate ; that each of these deponents saw OSSIAN G. HOWARD, the other witness to said Will sign his name to said instrument in the presence of the said deceased. Sworn and examined before me, [signed] MARCUS LYON Surrogate. [signed] JAY B. KLINE GEORGE D. BEERS of said County being duly sworn says that he knew OSSIAN G. HOWARD, now deceased, in his lifetime; that said OSSIAN G. HOWARD is now dead. That this deponent knows the hand writing of said OSSIAN G. HOWARD, having often seen him write, that the said Last Will + Testament of said ANDREW W. REED, now produced and shown to deponent is in the hand writing of said OSSIAN G. HOWARD, and that the signature, "O.G. HOWARD" to said Last Will and Testament as a subscribing witness, is the true and genuine signature and hand writing of said OSSIAN G. HOWARD. Sworn and subscribed before me - [signed] MARCUS LYON. REED, the Testator - above named in his life-time, that he knows the hand-writing of said ANDREW W. REED, having seen him write, that in his opinion + belief of this deponent, the signature, "ANDREW W. REED" to the instrument now shown to deponent + which purports to be the Last Will and Testament of said ANDREW W. REED is the true and genuine signature and hand-writing of said ANDREW REED, now deceased - Sworn + subscribed before me - [signed] MARCUS LYON. Surrogate - [signed] JOHN S. McGOWEN said will is in the words + figures following - In the name of God. Amen, I, ANDREW W. REED of Ithaca, Tompkins County N.Y. of the age of seventy five years being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament, that is to say: First. After all my lawful debts are paid and discharged, I give and bequeath unto my wife ELEANOR the use during her natural life of all my property both real and personal, with so much of the personal property absolutelyas may be necessary for her comfortable support. Second. At the death of my said wife my property is to be sold and of the avails two hundred dollars I give and bequeath to my daughter MARY, with all the furniture suchas paid for, and as much furniture in addition as either of her sisters have received from me - which furniture is not to be included in the sale of my other property - Third. All the rest residue and remainder of the avails of my property is to be divided equally between my six children HORACE, TRUMAN, ELIZABETH CAMPBELL, MARY, OLIVE BROWN, and EMMA BUSH + I give + bequeath the same to them equally: in case either of them dies before this legacy rests in them, such ones share to go to his or her being at law. And my executors herein named shall have power to sell and convey any of my real estate before my wifes death upon my wifes request + invest the proceeds in safe securities, the interest to be paid to my said wife for her life as aforesaid - Likewise, I make, constitute and appoint my trusty friend + neighbor JOHN S. McGOWAN to be executor + my wife ELEANOR to be executrix of this my last Will and Testament, hereby revoking all former wills by me made. In witness whereof, I have hereunto subscribed my name and affixed my seal the sixth day of June in the year of our Lord one thousand eight hundred and seventy two - [signed] ANDREW W. REED. L.S. The above written instrument was subscribed by the said ANDREW W. REED in our presence and acknowledged by him to each of us: and we at the same time declared the above instrument, so subscribed, to be his last Will and Testament: and we at his request have signed our names as witnesses hereto, in his presence and in the presence of each other and written opposite our names our respective places of residence - [signed] O. REED late of the Town of Ithaca in the COUNTY of TOMPKINS, and State of New York, deceased, at the time he executed the same, was in all respects competent to devise real estate, and not under restraint; the said last Will and Testament, and the proofs and examinations relating thereto, are hereinbefore recorded by me, pursuant to the provisions of the Revised Statutes; and I certify that the foregoing is a true record of said last Will and Testament and of the original proofs relating thereto.
