Present, Hon. Bradford Almy, Surrogate. Surrogate's Court Tompkins County In the Matter of the probate of the will of Helen A. Ammack Rush McDaniels, the residuary legatee named in the will of said deceased having, on the 4th day of October 1900 filed in Surrogate's Court his petition praying for the probate of the will of said Helen A. Ammack, deceased, bearing date the 25th day of May 1900 and praying that the heirs and next of kin of said deceased be cited to attend the probate thereof and that letters of administration with the will annexed be granted according to law to said petitioner and satisfactory proof having been made of the due service of such citations hereto fore issued in this matter requiring the proper parties to be and appear before the Surrogate of the county of Tompkins on the 3rd day of December 1900 at 10 o'clock in the forenoon to attend this probate of the last will and testament of said Helen A. Ammack late of the town of Enfield in the county of Tompkins deceased bearing date the 25th day of May 1900 and Gillette Hausner, the executor named in the will having refused to serve or qualify as executor of said will and having duly filed his renunciation thereof August 2nd. 1900, and the said Rush McDaniels having appeared in person and by Tompkins, Cobb & Cobb, his attorneys, in support of the proof of said will and Ella Tichenor and Cora Cole legatees under a previous will having appeared in person and by Simeon Smith, Esq., their attorney and filed an answer in opposition thereto and no other parties or persons having appeared herein and witnesses having been examined and proof taken touching the facts and circumstances attending the execution of said will and of the competency of the said Helen A. Ammack to execute the same as and being her last will and testament and as to whether the said will was her free and vol- untary act or whether under influence was exerted over said testatrix to cause her to execute the said will and the said Surrogate having heard the proofs and allegations of the parties and mature deliberation having been had there- on and the matter having been adjourned to this date, it is Ordered, Adjudged And Decreed that said instrument in writing bearing date the 25th day of May 1900 purporting to be the last will and testament of said Helen A. Ammack, deceased, was properly executed and is genuine and valid; that the said Helen A. Ammack at the time of the execution of said instrument was in all respects competent to execute the same and was under no restraint or undue influence; that said instrument be and the same hereby is admitted to probate and established as a will of real and personal property; that the same be recorded and that letters of administration wilt (with?) the will annexed issue to Rush McDaniels upon taking the oaths required by statute and on his executing the usual bond required in such cases in the sum of $400.00 within thirty days after the entry of this decree. It is Further ordered, Adjudged And Decreed that said administrator with the will annexed pay from said estate the costs and expenses of procuring said will to be admitted to be adjusted to probate and also the stenographer's bill. It Is Further Ordered, Adjudged And Decreed that the objections to the probate of said will be and the same are hereby dismissed as unproven and unsustained. Bradford Almy, Surrogate A true copy. Fred L. Clock Clerk of Surrogate's Court Said last Will and Testament is in words and figures following, to wit;- Last Will and Testament. I, Helen A. Ammack of the Town of Enfield County of Tompkins and State of New York being of sound mind and memory, do make, ordain, publish and declare this to be my last Will and Testament, in manner and form following, that is to say. First. After all my lawful debts are paid and discharged, I give and bequeath to Mary Hughston, wife of P. L. Hughston my India Shawl. II I give and bequeath to Adelaide Soule my gold watch and chain. I give to Josie Wright one feather bed III I give and bequeath to Helen A. Ward my set of silver spoons marked 'Helen' IV I direct that my diamond ring be sold and the proceeds given to the Old Ladies House of Ithaca, in the name of Dr. Mary Nivison. V I give and bequeath the residue and remainder of my property of every name and nature to Rush McDaniels for his use and benefit. Likewise, I make, constitute and appoint Gillette Hausner to be my executor of this, my last Will and Testament, hereby revoking all former wills by me made. In Witness Whereof, I have hereunto subscribed my name and affixed my seal, the 25th day of May, in the year of our Lord one thousand nine hundred. Hellen A. Ammack (L.S.) We, whose names are hereto subscribed, do certify that Helen A. Ammack the testator, subscribed her name to this instrument in our presence, and in the presence of each of us, and at the same time she declared in our presence and hearing that the same was her last Will and Testament, and requested us, and each of us, to sign our names thereto as witnesses to the execution thereof, and which we hereby do in the presence of the testator and of each other, this 25th day of May 1900, the day of the date of the said Will, and write opposite our names our respective places of residence.
