Present: MARCUS LYNN: Surrogate In the matter of the last will and testament of JACOB HENDRIX, Deceased An Instrument purporting to be the last will of JACOB HENDRIX dated the 8th day of May, 1888 was produced in court and shown to each of the persons sworn as witnesses to the execution of said Will, as hereinafter mentioned. HULDAH M. VAIL, of the town of Newfield in the County of Tompkins, and JOHN W. DEAN of the town of Newfield and the County of Tompkins, being each duly and severally sworn as witnesses, do each depose and say, that they were acquainted with the above mentioned JACOB HENDRIX, the testator, now deceased in his lifetime; that they each saw the Testator subscribe, at the end thereof, the instrument now shown to deponents, purporting to be the Will of said Testator, subscribed their names as witnesses to the execution of said Will in the presences and at the request of said Testator was at that time, in the opinion and belief of each deponents, of sound mind and memory, and was not under any restraints; and was about 65 years of age; that said Testator died on or about the 3rd day of June, 1888, and was a resident of the town of Newfield in the county of Tompkins, at the time of his death. DEAN Said Last Will and Testament in the words and figures to wit: IN THE NAME OF GOD, AMEN J.JACOB HENDRIX of Newfield, Tompkins County, New York, age 67 years. Being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make and ordain, publish and declare this to be my last will and testament, that is to say: First after all my lawful debts are paid and discharged, I give and bequatte to my wife ELSIE the use of all my real and personal property during the term of her natural life (except such as may herein after devised) 2nd: after the decease of my wife, I give, I give to my daughter MARY all of my household furniture of every description, my cow, pigs, and poultry that may there remain 3rd I give to my son ALONZO my double barreled gun. 4th: I give to CHARLES VAN CLEAF my single barreled gun 5th: Immediately after the decease of my wife, I direct my executor herein after named to sell at private or public sale as he may deem best, my real estate and divide the proceeds equally between my daughters HANNAH, AMANDA and MARY, and my sons ALONZO and JACOB share and share alike. I also hereby authorize my executor to collect the sum of $16.40 of my son WALLACE and the sum of $42.00 of my son JACOB, which they owe me, with which to defray my funeral expenses. Likewise, I make, constitute and appoint HOLDEN BROWN of Newfield, N.Y. to be executor of this my last will and testament, hereby revoking all former will by me made in witness whereof. I have hereunto subscribe my name and affix my seal, the eighth day of May in the year of our Lord one thousand eight hundred and eighty eight JACOB (x) HENDRIX The above written instrument was subscribed by the said JACOB HENDRIX in our presence and acknowledgement by him to each of us, and at the same time declared the above instrument, so subscribed, to be his last will and testament, and we at his request have signed our names as witnesses hereto in his presence and in the presence of each other, and written opposite our names our respective places of residence. Satisfactory proof by affidavit having been made and filed of the due service of the citation heretofore issued in this manner; requiring the proper persons to appear in the court on the 13th day of January, 1890 at 10 o'clock in the forenoon, and attend the probate of the Will of JACOB HENDRIX . Late, of the town of Newfield in the County of Tompkins, state of New York, deceased and HOLDEN BROWN, sole executor in said Will would, in person and by RANDOLPH HORTORE, esq., his attorney. Having appeared in support of the probate of the said will, no contesting said probate, and after hearing the proofs and allegations of the said Executor, and duly deliberating thereon; it is ADJUDGED AND DECREED, that the said Will was duly executed; that the same is genuine and valid, and that the said JACOB HENDRIX, the Testator, was at the time of executing the same, in all respects competent to make a Will, and do devise Real Estate, and was not under any restraint.. And this COURT DOTH FUTHER ORDER AND DECREE; that the said Will, and proofs and examinations taken in respect to the same recorded, and the said Will be admitted to PROBATE, and the same be, and hereby is, established as a Will relating to the Real and Personal Estate. Dated the 13th day of January, 1890. Additonal comments: there is one more son that was not mentioned in the will, it was James Hendrix, he moved to Missouri and his family still lives here.
