Present, Bradford Almy, Surrogate In the Matter of Proving the Last Will and Testament of William H. Ammack, Deceased. An Instrument, purporting to be the last Will and Testament of William H. Ammack bearing date the 31st day of March in the year 1882, was produced in court, and shown to each of the persons sworn as witnesses; as hereinafter mentioned. Alex V. Stobbs of the Town of Hector in the county of Schuyler being first duly sworn, deposeth and saith, that he was acquainted with the above mentioned William H. Ammack deceased, in his lifetime; that he saw the said William H. Ammack deceased, subscribe at the end thereof, the instrument now shown to this deponent, purporting to be the last Will and Testament of the said Testator and above described; that he heard the said Testator declare the same to be his last Will and Testament; that this deponent subscribed his name as a witness thereto in the presence and at the request of the said Testator; that the said Testator was at the time in the opinion and belief of this deponent, of sound mind and memory, and not under any restraint; and that he was about 48 years of age; that he died on or about the 27th day of October 1899, and was a resident of the Town of Enfield in the county of Tompkins at the time of his death. Sworn and examined before me January 2nd 1900, Bradford Almy (That Richard Leonard the other subscribing witness to said Will is now deceased. That I was present and saw him sign said Will as a witness.) Said Last Will and Testament is in the words and figures following, to-wit: The Last Will and Testament of William H. Ammack of the Town of Enfield County of Tompkins and State of New York. I, William H. Ammack aware of the uncertainty of life, do make, ordain, publish and declare this my last Will and Testament, in manner and form following, that is to say: After the payment of my funeral charges, the expenses of administering my estate, and my lawful debts, I give, devise and bequeath my property as follows: First: I Give, devise and bequeath unto my beloved Wife, Hellen A. Ammack, all my property, both Real and personal of every kind and name, Wheresoever the same shall be situated, to be used and enjoyed by her for her support and maintenance in such way and manner as she shall choose, With full power to change it from Real to personal, and from personal to Real, and to use any part or thewhole of it up for her comfort, support, and maintenance. any whole estate to be hers absolutely with this proviso that whatever remains of it, at her decease, shall be disposed of as follows, (to wit) One half of such residue, or remainder if any, I give devise, and bequeath, unto my Sisters, Emily Smith, Lydia Cleaveland, Mary Howland, Amy Nivison, Phoebe Gates, Maria Tichenor & Ann Eliza Tichenor, or their heirs, in case of the death of either of my said Sisters, previous to the death of my said Wife, or those of them who have heretofore died leaving children. The other half of such residue, or remainder, I give devise and bequeath unto my Nephews, and Neices, the children of my said Sisters, that shall be living at the death of my said Wife, to be divided between them, share and share alike, to each. Likewise, I make, constitute and appoint my said Wife, Hellen A. Ammack to be executrix of this my last Will and Testament, hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto subscribed my name and affixed my seal the 31st day of March in the year of our Lord one thousand eight hundred and eighty-Two. William H.
