Humiston, Deceased - An Instrument, purporting to be the last Will and Testament of Jane E. Humistion bearing date the 8th day of February in the year 1900, was produced in Court, and shown to each of the persons sworn as witnesses, as hereinafter mentioned. - James L. Baker of the town of Ithaca in the county Tompkins being first duly sworn, deposeth and saith, that he was acquainted with the above mentioned Jane E. Humiston deceased, in her lifetime; that he saw the said Jane E. Humiston deceased, subscribe, at the end thereof, the instrument now shown to this deponent, purporting to be the last Will and Testament of the said Jane E. Humiston and above described that he heard the same Testator declare the same to be her last Will and Testament; that this deponent subscribed his name as witness thereto in the presence and at the request of the said Testator; that the said Testator was at the time, in the opinion and belief of this deponent, of sound mind and memory, and not under any restraint; and that she was about 73 years of age; that she died on or about the 10th day of July in the year 1902, and was a resident of the city of Ithaca in the County of Tompkins at the time of her death. - [signed] James L. Clock, Clerk of Surrogate's Court - Said Last Will and Testament is in the word and figures following, to-wit: - In the Name of God, Amen. I, Jane E. Humiston, aged seventy three years, of the City of ithaca in the County of Tompkins and State of New York; being of sound mind and memory , do make, publish and declare this my last Will and testament, in manner following, that is to say: - First. - I direct that all my just debts and funeral expenses be paid. - Second. - I give, devise and bequeath my house, lot and premises situate on Linn Street in said city of ithaca, on which lot I now reside and being the same premises conveyed to me by E. Sydney, to my son William H. Humiston, subject however, to the payment by him of the sum of One Hundred dollars to my daughter Ida Williams, and of the sum of One Hundred Dollars to my son Jasper W. Humiston, and of the sum of Three Hundred Dollars to my daughter Cora Slater. Said sums so directed to be paid to be a charge upon said premises. He is also to pay my debts and funeral expenses. - Lastly, I hereby appoint my said son William H. Humiston to be sole executor of this my last Will and Testament hereby revoking all former wills by me made. - In Witness Whereof I have hereunto subscribed my name the Eighth day of February in the year of our Lord one thousand nine hundred. (1900) - [signed] Jane E. Humiston (Seal) - We, whose names are hereto subscribed, Do Certify that Jane E. Humiston the testatrix subscribed her name to this instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing, declared the same to be her last Will and Testament, and requested us, and each of us, to sign our names thereto as witnesses to the execution thereof, which we hereby do in the presence of the testatrix and of each other, on the day of the date of the said Will, and write opposite our names our respective places of residence. - James L. Baker residing at No. 117 Hudson St. Ithaca, N.Y. Bert L. Baker residing at 117 Hudson St., Ithaca, N.Y. - In the same matter: On the 18th day of August, 1902 Satisfactory proof having been made and filed of the due service of the Citation heretofore issued in this matter, requiring the proper persons to appear in this Court on the 18th day of August A.D., 1902, at 10 o'clock in the forenoon, and attend the probate of the last Will and Testament of Jane E. Humiston late of the city of Ithaca, in the County of Tompkins and State of New York, deceased, and Ida Williams and Cora Slater having appeared in person and Jas. L. Baker, Esq. Attorney for the executor having appeared in support of the proof of the said Last Will and Testament, after hearing the proofs and allegations of the said executor and duly deliberating thereon; It is Adjudged and Decreed, that the said last Will and testament, was duly executed; that the same is genuine and valid; and that the said Jane E. Humiston, deceased, at the time of executing the same, was in all respects competent to make a last Will and testament, and to devise Real Estate, and was not under any restraint. And this Court doth Further Order and Decree that the said last Will and Testament, and the proofs and examinations taken in respect to the same, be recorded, and that the said last Will and Testament be admitted to Probate, and that the same be and hereby is established as a Will of Real and Personal Estate. - [signed] Bradford Almy Surrogate. - Tompkins County, ss.: I do hereby certify that the foregoing is a true record of the original last Will and Testament of Jane E. Cora (nee' Humiston) Slater; given name of Mr. Slater, unknown.
