AE14 (1768) In the name of God, Amen, March 5, 1761. I, SAMUEL ERWIN, of Ulster County and province of New York, yeoman, being of perfect and reasonable health and perfect mind and memory thanks be given to god for it calling unto mind the mortality of my body and knowing that it is apointed for all men ? to die, do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hand of almighty God that gives it and my body I recommend to ye earth to be buried in a decent and christian like burial at ye direction of my executors I shall hereafter name and as touching ? worldly estate where with it hath pleased God to bless me within this life I give ? and dispose of ye same in ye following manner and form. First of all I order all my just debts and funeral charges to paid by my executors. I give unto my dear and well beloved wife Prudence , the use of my homestead, being 180 acres, with all apportenances. After the death of my wife I leave all the same to my son William. I leave to my wife all my movables. I leave to my son Samuel 180 acres of land on the west end of the lot I bought of Dennis McPeak. "And if it so be that it runs within Edward Erwin's inclosure, he must let him have it at ye prime cost." I leave to my son Edward 55 acres of land with what he now possesses over the land which he bought, which will make 180 acres. I leave to my sons, George Erwin and John Erwin, 360 acres of land to be equally divided to them and their heirs forever and they are to have use of such working creatures as can be spared from the homestead. I leave to my daughter Phebe œ30, and a bed and furniture, to be paid by my sons. I leave to my daughter Margaret a cow, "if she comes to the Highlands." To my granddaughter Phebe œ5 when of age. I make my sons, Samuel and Edward, executors. Samuel Erwin George Burne Francis Burne Jane Morran Ulster County It is remembered that on the eighteenth day of January, one thousand seven hundred and sixty eight, personally came and appeared before me, George Clinto ? surrogate of the said county,Francis Burnee of the ? of the aforesaid , yeoman and being duly sworn on his oath declared that he did see Samuel Erwin sign and seal the ? written instrument perporating to be the will of the said Samuel Erwin bearing date the fifth day of March 1761 and heard him ? and declare the same as and for his last will and testament that at the time thought the said Samuel Erwin was of sound mind and memory to the best of the knowledge and belief of this desponent and that his name subscribed to the said will is of his hand within which he subscribed as a whitness to the last will in the testators ?? that he was George Burne and Jane Morran the other witness to the said will subscribe his name and make her mark as witnesses in the testator's will.
