All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm *********************************************************************** Source: sampubco.com Original Wills AH-35 also recorded New York co NY Will Book Vol. 26 page 327 Written: 20 Apr 1757 Probated: 23 May 1767 The Will of Benjamin Hains In the name of God Amean the twentieth Day of aprile in the year of our Lord one Thousand and Seven hundred and fifty seven I Benjamin hains Sinior of the Precinct of Walkill in the County of Ulster and province of New York yoeman (farmer) being of sound mind and memory Blessed be God for it therefore calling into mind the mortality of my Bodey and know that it is appointed for all men once to Die do make ordain and publish this my last Will and Testament that is to say principally and first of all I give and Recommend my soul in the hands of God that gave it and for my Bodey I Recommend it to the Earth to be buried in a Christian like and Decent manner at the Discretion of my Executors nothing Doubting but at the general Resurrection I shall Receive ye same again by the mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me with in this life I give Devise and Dispose of the same in the following manner and form. First of all I order and it is my will that all my just Debts and funeral Expenses and legacies herein after mentioned be well and truly paid out of my personal Estate. Also I give and bequeth to my well beloved Daughter Susanah Goaldsmith one graite (great) bible which I now make use of. She is to leave it to her son Benjamin Goldsmith at her Death. Also I give and bequeth to my son Nathan hains one bed two coverlids (coverlets) and one bolster. I Do also give to my son Nathan ten pounds of money that I promised to him at my Death if I have so much money by me at my Death. Also I give and bequeth to my grand Daughter Susannah Goaldsmith one bed two coverlids and one bolster. Also I give and bequeth to my grand Daughter Susannah hains Daughter of Benjamin hains one Dutch spinning wheele and one small trunck. Also I give and bequeth to my Grand Daughter Abagail hains Daughter of my son David hains the sume of five shillings. Also I give and bequeth to my Daughter Susanna hains Wife of Samuel hains one brass kettle and one pair of hand Bellows. Also I give and bequeth to my grand son David hains son of Samuel hains one small bed and two coverlids and one bolster. Also I give and bequeth to my Grand son benjamin hains son of Samuel hains twenty pounds of money New York Currancy to be put out to intrest for him till he arives at the age of twenty one years. But if he Dies before he arives at the age of twenty one years then I order the said twenty pounds to be Equaly Divided amongst my four Children Susanna Goldsmith, Benjamin hains Nathan hains and Samuel hains. Also I give and bequeth all my wearing cloaths to my three sons Benjamin Nathan and Samuel to be Equaly Divided amongst them all. Also, I give and bequeth to my son Samuel hains my whole plantation (farm) that I now possess which plantation I bought from John McNeal and mr. Alexander of New York containing one hundred and four acres together with all the Buildings and Improvements on said plantation to him and his heirs for Ever and I give and bequeth to my son Samuel hains a Road through the land which I gave to my son David hains, that is to say ____ Road through to the water side Road. Also I give and bequeth to my son Samuel hains all my Chattle (cattle) and horses and all my farm tacklings and I give to him one Bed one Bolster and two pillows two coverlids and one set of Curtains. Also it is my will that when all my just Debts funeral Expenses and Legacies aforesaid mentioned are well and truely paid and Discharged if there be any remainder of my moveble Estate my will is that said Remainder be Eaqualy Divided amoungst my four Children Susanna Goaldsmith benjamin hains Nathan hains and Samuel hains and I make Constitute and ordain my well beloved son Samuel hains that now lives with me on my plantation my only and sole executor of this my last will and Testament in trust for the Intent and purposes in this my Last Will Contained and Do hereby utterly Disalow Revoke Dasanull all and Every other former Testaments wills Legacies and Executors by me in any wise before this time ____ Bequethed ___ and Confirming this and no other to be my Last Will and Testament.
