I Cornelius Vernooy of Rochester County of Ulster and Province of New York Farmer being of sound and disposing mind memory and understanding do make and declare this my last Will and Testament in manner and form following hereby revoking and annulling all and all manner of Wills Testaments and Devises by me heretofore made that is to say, first I will and desire that my Body shall be decently interred in such a Manner as my Executors hereinafter named or the Survivors or Survivor of them shall think fitt and that all my just Debts shall be by them paid in convenient Time after my Decease Also I give and devise unto my Eldest son Cornelius Vernoy Jr. one horse the choice of my Horses in full Barr ?? of what he can or may claim as my heir at Law and as to the one fourth part of the rest and Residue of my personal Estate I give devise and bequeath the use and Occupation thereof unto Margerith the Widow of my son Coeuract Deceased for and during the time she shall remain his Widow and if she do not marry again then for and during her natural Life and after her Decease or Remarriage which of them may first happen I give devise and bequeath the same unto the six children of my said son Coeuract deceased to wit, Cornelius, Sarah, Andries, Simeon, Jonathan and Cornelia to be by them or their respective Executors or assignees equally divided Share and Share alike. And as to the rest and residue of my personall Estate I give devise and bequeath the same unto my three Sons to wit Cornelius Jacob and Wessel to be by them or their respective Executors or Assigns equally divided Share and Share alike Also I give devise and bequeath part of my real Estate unto my said son Wessel beginning by a swing Gate standing on the Road between my House and the house of my said Son Coeuract deceased opposite the Burying place thence with a straight line in a square with the Division Line of the Orchards of me and Johannis Vernooy to the said Division Line thence along the said Division as it runs to the Lowland thence along and over the said low Land following the Division Line of me and said Johannis Vernooy untill a swing Gate standing on the Road that leads to my Lowland thence up the Hill with a straight line following the general Course of a brush fence untill opposite the said burying place so as to run with a straight Line tutching the said burying Place to the first swing Gate of the place of Begin together with the house barn Orchard to him and his respective heirs and assigns for ever. Also I give devise and bequeath unto my said two sons Corneluis and Jacob Vernooy each of them as many acres of bush Land as the Lott contains which I heretofore conveyed to my said son Coenract deceased for a house Lott which lays near the Wawarsink Church they shall take the said Bush Land on the East side of the Kings road next unto the said house Lott to each of them their respective heirs and assigns for Ever. Also I give devise and bequeath unto Margerith Widow of my said son Coenract deceased the just one fourth part of the rest and residue of my Real Estate for and during the Time she shall remain his Widow and after her Remarriage or Decease which of them shall first happen I give devise and bequeath the said just one fourth part of the residue of my said real Estate unto the six children of my said son Coeuract deceased herein before named that is to say, one just and equal sixth part thereof to each of them and their respective heirs and assigns for ever. Also I give devise and bequeath unto my three sons herein before named, all the rest and residue of my real Estate that is to say one just and equal third part thereof to each of them and their respective heirs and assignes for Ever and in case one or more of my said Children should Die before me without Issue of their body begotten then his or their Share shall be equally divided among the rest of my children and the Children of my said son Coeuract deceased in manner as aforesaid But if any of my said Children should die before me leaving issue of his or their bodies then my will and desire is that his or their part of my real Estate shall be equally divided between the Issue of each of my said children so dying as aforesaid leaving Issue. Lastly I do nominate constitute and appoint my three sons Cornelius Jacob and Wessel and my Granson Cornelius Corn't Vernooy Executors of this my last Will and Testament desiring them to see the same in all parts well and freely performed. In Witness whereof I the said Cornelius Vernooy have to this my last Will and Testament set my hand and Seal the twenty seventh day of January in the year of our Lord one thousand seven hundred and fifty six. I Cornelius Vernooy of the Township of Rochester in the County of Ulster and Province of New York do this sixteenth of January in the year of our Lord Christ one Thousand seven hundred and sixty seven make and publish this my last Codicil to my last Will and Testament bearing date the twenty seventh day of January one Thousand seven hundred and fifty nine in manner following (that is to say) Whereas in and by my said last Will and Testament I have given and bequeathen to my Grandson Simeon Vernooy part of my real and personal Estate and he being since Deceased I do hereby declare that my Will is that, that part of my said real and personal Estate so given to him as aforesaid shall be equally divided Share and Share alike among his Brothers and Sisters to wit Cornelius Coen Vernooy Audries Vernooy Jonathan Vernooy Sarah Vernooy and Cornelia Vernooy to the proper use of them and their respective heirs and assigns forever And if any of the Children of my said son Coeuract Vernooy deceased shall die before he she or they come to the age of twenty one without Issue of their Body begotten that Share or Shares shall be equally divided between the surviving Children of my said Coeuract Vernooy deceased or their heirs or assigns. Also my Will and desire is that Andries DeWitt Esq. Capt. Johannis Bevier and Cornelius J. Vernooy of the Township of Rochester and County and Province aforesaid; or the Survivors or Survivor of them shall make Partition and Division of all my real and personall Estate in behalf and for and instead of my grand Children that are Minors at the Time of my Decease or partition and Division of my said Estate and Settlement thereof who shall have any Share of my said Estate after my Decease by virtue of my said Will and Testament and this my last Codicil or otherwise. Together with my Children and other Grand Children that are of the Age of twenty one years in each Share and Proportions and in such manner as my said last Will and Testament and this my last Codicil directs which Partition and Division shall be made a convenient Time after my Decease. Also my Will and desire is that the said Andries DeWitt Esq. Capt. Johannis Bevier and Cornelius J. Vernooy the Survivors or Survivor of them shall Release and Convey in Writing unto my Children and Grand Children that are of the age Twenty one years aforesaid and to their heirs and assigns for Ever their shares of my real Estate that shall fall unto them by such Partition and Division as aforesaid. Also my Will and desire is that my said Children my Grand Children that are minors as aforesaid and to their heirs and assigns forever their Shares of my said real Estate that shall fall unto them by such Partition and Division as aforesaid. And lastly it is my Will desire that this my present Codicil be annexed to and made part of my said last Will and Testament to all Intents and purposes. Be it Remembered that on the fifth day of September one thousand seven hundred and sixty eight personally came and appeared before me Joseph Gasherie Surrogate of the said County Andries DeWitt Jr. of the Township of Rochester in said County Esquire and being duly Sworn on his Oath, declareth, that he did see Corneluis Vernooy sign and seal the Instrument hereunto annexed purporting to be the Will of the said Cornelius Vernooy bearing date the twenty seventh day of January One Thousand seven hundred and fifty nine And heard him publish and declare the same as and for his last Will and Testament that at the time thereof he the said Cornelius Vernooy was of sound disposing mind and memory to the best of the Knowledge and Belief of him the Deponent And that his name subscribed to the said Will is his proper hand Writing which he subscribed as a Witness to the said Will in the Testators presence. And that he the deposed saw Cornelius ? Vernooy and Johannis Vernooy Junr the other Witnesses to the said Will subscribe their Names as Witnesses thereto in the Testators presence. Also personally came and appeared before me the said Joseph Gasherie Surrogate of the said County Jurry Mack of the Township of Rochester in said County Labourer and being duly Sworn on his oath declareth that he did see Cornelius Vernooy sign and seal the Instrument annexed to the said Will, perporting to be as a Codicil to be annexed to the Will of the said Cornelius Vernooy bearing date the sixteenth day of January one thousand seven hundred and sixty seven. And heard him publish and declare the same as and for a Codicil to be annexed to his last Will and Testament; That at the time thereof he the said Cornelius Vernooy was of sound disposing mind and memory to the best of the Knowledge and belife of him the Deponent And that his Name subscribed to the said Codicil is his proper hand Writing which he subscribed as a Witness to the said Codicil in the Testators presence And that he the Deponent saw Johannis Vernooy and Nathan Vernooy the other Witnesses to the said Codicil subscribe their Names as Witnesses in the Testators presence. To all to whom these Presents shall come or may concern Greeting. Know ye, that at Ulster county on the fifth day of September last before Joseph Gasherie Esquire thereunto delegated and appointed the last Will and Testament of Cornelius Vernooy deceased (a Copy whereof is hereunto annexed ) was proved as is now approved and allowed of by me. The said deceased having whilst he lived and at the time of his Death Goods Chattels and Credits within this Province by means whereof the proving and registering the said Will and the granting Administration of all and singular the said Goods Chattels and Credits and also the Auditing allowing and final discharging the account thereof doth belong unto me And that Administration of all and singular the Goods Chattels and Credits of the said Deceased and any way concerning his Will is granted unto Jacob Vernooy Wessel Vernooy and Cornelius Cornl Vernooy three of the Executors in the said Will named being first duly Sworn well and faithfully to Administer the same and to make and Exhibit a true and perfect Inventory of all and singular the said Goods Chattels and Credits and also to render a just and true account thereof when thereunto required. In Testimony whereof I have Caused the Prerogation Seal of the Province of New York to be hereunto affixed at the City of New York the seventh day of October on Thousand seven hundred and sixty eight. By his Excellancy's Command
