A page 137 Dated 29 September 1766 Transcribed by Linda Helaudais from Sampubco copy In the name of God Amen, I Robert Graham of the precinct of Shawangunk in the County of Ulster and Province of New York Yeoman, Being in health of Body and of sound and perfect mind and memory and understanding thanks be to almighty God but considering my great age beyond the common course of nature, the uncertainty of this transitory life, and that I must soon yield unto Death when it shall please God to call Do make this my last Will and Testament in manner and form following: that is to say First and principally I Recommend my Soul unto almighty God and my Body to the Earth to be decently buried at the discretion of my Executors hereafter named. As Touching such Worldly Estate as it hath pleased God to bestow upon me, my Debts and funeral charges being first paid and discharged, I Give Devise and bequeath the same as followeth: Item. I give and Devise unto my son John Graham All that a certain Lott piece or parcel of Land being now in the occupation of my said son John Beginning upon the bounds of the Land of Abraham Decker at the Northernmost corner of Robert Cane's Land and Runs from thence along the division line between my land and the land of the said Robert Cane as it runs South Sixty-six degrees East thirty-seven chain and Seventy-two links to a Black Oak Tree standing on the East side of a Ridge marked with a Cross and two Notches on the North side thereof being an Old line Tree marked in the line between me and the said Cane and Runs from thence crossing my land North twenty-four degrees East fourteen chain to the North East bounds of the patent of William Peartree and Company thence along said Bounds as it runs North Sixty Six Degrees West twenty-four chains and forty links to a lott of land by me conveyed to Isaac Hasbrouck then along the same South Twenty-four degrees West five chain and ninety links and north sixty-six degrees West Eleven Chain to the land late of Jacob Decker now of Jacobus Vanderline and thence along the same and the land of Abraham Decker South forty degrees West eight chains and forty links to the place where it began, containing about forty-three Acres To Hold the said lott piece or parcel of Land with the appurtenances unto my said son John Graham for the term of his natural life and after his decease I give and devise the same to my Grandson Robert Graham, one of the younger sons of my said son John and to his heirs and assigns forever But if in case my said grandson Robert shall happen to decease without issue of his Body begotten during the lifetime of my said son John then to my grandson Andrew, one of the other of the sons of my said son John and to his heirs and assigns forever, And as for the Residue of my Real and personal Estate (not herein before by me disposed of) I Give and dispose thereof in manner and form following (Viz) my just debts and funeral charges being first paid and deducted out of the same, my will is that my said Real and personal estate be equally divided into six parts or shares, and one-sixth thereof I give devise, and bequeath unto my son Andrew Graham his heirs, Executors administrators or Assigns; one other sixth part thereof unto my son Robert Graham, his heirs Executors administrators or assigns; one other sixth part thereof unto my grandson John Graham, Junr. (the son of my said son John) and to his heirs, executors, administrators, or assigns; one other sixth part thereof unto my daughter Mary, the Wife of Robert Cane and to her heirs, executors, administrators, or assigns; one other sixth part thereof unto my daughter Elizabeth, the wife of James Dayly and to her heirs, executors, administrators, or assigns; and the other sixth part thereof unto my Grand Children, the Children of my daughter Jane, deceased (the late wife of Jacobus Bruyn) to be equally divided between my said last-mentioned grand Children, each of them an equal proportion thereof. Also I do Give unto my Wife Antie the use of one cow and such part of my Beding and Household goods as my Executors hereinafter named shall judge needful for her, and also a maintenance to be allowed her out of my said estate at the discretion of my Executors as I shall hereinafter direct. And I do make ordain and appoint my said son Andrew Graham and my son-in-law Jacobus Bruyn to be Executors of this my last Will and Testament and my Will and meaning is that my said Executors shall within a convenient time after my decease make a Sale of all my Estate Real and personal (Except what I have herein before given to my son John and a Cow and such beding and household goods as they shall Judge needfull to keep for the use of my wife during her lifetime) For the Doing Executing, and perfect finating [?] whereof I do by these presents Give Grant Will and Transfer to my said Executors and their respective Executors and Administrators full power and Authority to Grant Alien Bargain Sell Convey and Assure all my Lands or other Real Estate (Except what I have herein before given to my said son John) to any Person or Persons and their heirs forever, in fee simple by all and every such lawfull ways and means in the Law as to my said Executors or their respective Executors or Administrators or their Council learned in the Law shall seem fitt or necessary. And In order to Enable my Executors to allow unto my said Wife Antie her maintenance so given her as aforesaid, it is further my Will that my said Executors shall retain in their hands during the lifetime of the said Antie part of the money to arise by the sale of my said estate a sum of two hundred pounds, and that they shall put the same out at use and out of the interest thereby arising shall give her the maintenance to be allowed her as aforesaid, and the remainder of the money arising by such sale as aforesaid I order and appoint my said executors to pay unto my said Children and Grand Children their Executors Administrators or Assigns According to their Respective Rights or Interests in my said Estate And The money so to be retained together with the interest thereby arising, if any remains, shall be divided as soon as my Executors shall be discharged from the maintenance of my said wife. And Lastly I do hereby Revoke and make void all former and other Wills by me heretofore made, declaring this only to be my last will and testament In Witness whereof I have hereunto sett my hand and seal this twenty-ninth day of September in the year of our Lord Christ one thousand seven hundred and sixty-six. [signed] Jacobus Sammon Charles Lomex Peter Decker Ulster County: Be it Remembered that on the twenty-sixth day of August in the year of our Lord One thousand seven hundred and eighty nine personally came and appeared before me Joseph Gasherie Surrogate of the said County, Peter Decker of the Town of Shawangunk in the said County Farmer, and being duly sworn on his Oath declared that he did see Robert Graham Sign and Seal the preceding written instrument purporting to be the Will of the said Robert Graham bearing date the twenty ninth day of September in the year of our Lord One thousand seven hundred and sixty-six and heard him publish and declare the same as and for his last Will and Testament that at the time thereof the said Robert Graham was of sound disposing mind and memory to the best of the knowledge and belief of him the deponent and that Jacobus Sammon and Charles Lomex together with the deponent Subscribed the said Will as Witnesses thereto in the Testators presence.
