I, Joseph Houston, of the Town of Montgomery, County of Ulster and State of New York Do this Sixteenth day of December in the year of our Lord one thousand seven hundred and ninety two, make and publish this my last will and Testament in manner and form following. That is to say, I commend my Soul unto Almighty God, who gave it me and my Body to the Earth, from whence it came in hopes of a Joifull Reserection through the merits of my Savior Jesus Christ, And as for that worldly Estate wherewith it has pleased God to bless me, I dispose therof as follows: First, I Give and bequeath to my loving wife Ann Houston all my Household Furniture and also a negro girl named Hannah. I also give her the use of the Farm whereon I now live togethere with all my farming utensals, for and during, for and during her natural Life and at her decease I give and devise my said Homstead Farm to my two youngest sons, Joseph and James Houston to be Equal between them and their Heirs forever. They paying the legacy to my son William hereafter mentioned. Item, I give and devise to my eldest son, Lebulon Houston to him and his heirs forever Lot No. Ten whereon he now lives and as much of the south end of Lot No 11 as will enclude the meadow and little field known by the name of Peter Puffs medow. Item, I give and devise to my second son William Houston, all the remainder of Lot No. 11 to him and his heirs forever. I also give and bequeath to my said son William Houston, the sum of Fifty pounds to be paid by my Executors two years after my decease. Item, I give and bequeath to my daughter Isabella one Horse or mare and Sid Saddle. I further give her the sum of one hundred pounds to be paid out of my personal Estate. Item, I give and bequeath to my Daughter Elizabeth Dill a Suit of mourning. Item, I give and bequeath to my Daughter Eley Dill a like Suit of mourning. Item, I give and bequeath to my two sons, Joseph and James Houston after my wifes decease, my negro man, Harry. It is further my will that if either of my two youngest sons Die under age, not having lawful issue that the Surviver hold the others part of the said Homestead Farm, and that he pay the following sums to the rest of his brothers and sisters. That is to his brother, Lebulon, the sum of Forty one pounds, twelve shillings. To his brother, William, the like sum in one year after the first payment. To his Sister Elizabeth Dill the like sum in two years after. To his sister Eley Dill the like sum in three years after. To his sister Isabella the like sum in four years after. It is also my will that in case my two youngest sons, Joseph and James Houston, shall die under age and not having lawful issue that then in that case, I give and devise the before Devised Homsted Farm to my two oldest sons, Lebulon and William Houston the paying to each of their sisters the sum of Fifty pounds to be paid in the order above mentioned. And lastly, I do hereby Constitute and appoint my well beloved wife Executrix. Be it remembered that on the fifth day of April in the year of our Lord One thousand seven hundred and ninety three personally came and appeared before me Joseph Gasherie, Surrogate of the said County, James Houston of the Town of Montgomery in the said County Yeoman. And being duly sworn on his Oath, declared that he did see Joseph Houston sign and seal the written instrument purporting to be the will of the said Joseph Houston bearing date the sixteenth day of December in the year of our Lord one thousand seven hundred and ninety two and heard him publish and declare the same as and for his last will and Testament that at the time thereof he the said Joseph Houston was of sound disposing mind and memory to the best of the knowledge and belief of him the deponent and that James Davis and John Nicholson together with the deponent subscribed the said Will as witneses thereto in the Testators presence. Know ye, that at Ulster County on the fifth day of April instand before Joseph Gasherie, Esq. Surrogate of our said County the last will and Testament of Joseph Houston deceased (a Copy whereof is hereunto annexed was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the Time of his death Goods, Chattels or Credits within This State by means whereof the ???? proving and registering the said Will and the granting Administration of all and Singular the said Goods, Chattels and Credits and also the Auditing allowing and final discharging the account thereof doth belong unto us the Administration of all and Singular the Goods, Chattels and Credits of the said deceased and any way concerning his Will is granted unto Ann Houston and Thomas Beaty, Jun., Executrix and Executor in the said Will named. They being first duly sworn, well and faithfully to Administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods, Chattels and credits and also to render to just and true account thereof when thereunto required . In testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed.
