This tenth day of July in the year of our Lord Christ one thousand seven hundred and eighty eight. I Daniel Schoonnmaker of Rochester County of Ulster and State of New York being in reasonable helath of Body and of sound and perfect mind memory and understanding thanks be given to almight God, but considering the uncertainty of this transitory life and that we must all yeild unto death, when it shall please God to call. Do make and ordain this my last Will and Testament that is to say First and principally I recommend my soul into the hands of God that gave it and my Body I Recommend to the Earth to be buried in a decent manner at the discretion of my Executors nothing doubting but at the general Resurrection I shall receive the same again by the mighty power of God and as touching such Worldly Estate wherewith it hath pleased God to bless one in this life I Give Devise and dispose of the same in the following manner and form. Imprimis it is my Will and I do hereby order and direct that my just Debts and funeral expenses expences be first paid and discharged within a convenient time after my decease out of my personal Estate before any division hereafter be made. I Give and bequeath unto by Elder son Thomas all and singular the Surveying Instruments in consideration of his being my first born and no more. I Give and devise unto my said Son Thomas and to his heirs and assigns forever All that certain Tract or parcel of Land situate at Jaaghrupelpush(?) in the Township of Marbletown in the said County whereon he now dwelleth. Together with all and Singular the buildings and improvements hereditaments and appurtenances unto the same belonging or in any wise appertaining to have and to hold the said Lands Tenements and hereditaments with the appurtenances unto my said Son Thomas and to his heirs and assigns to the only proper use and behoof of my said Son Thomas his heirs and assigns forever chargeable Nevertheless with the payment of the sum of Two hundred pounds Current lawful money of New york to be paid and applied as shall be herein after directed. I give and Devise unto my son Jochem and to his heirs and assigns forever, All my Real Estate lying and being within the limits and bounds of Rochester aforesaid that is all the Lands and Tenements together with all and Singular the buildings and improvements hereditaments and appurtenances unto the same belonging or in any wise appertaining To have and to hold the said Lands Tenements and hereditaments with the appurtenances unto my said Son Jochem and to his heirs and assigns to the only proper use and behoof of my said son Jochem his heirs and assigns forever. Chargeable Nevertheless with the payment of the sum of Two hundred pounds current lawful money as aforesaid to be paid and applied as shall be herein after directed. I Give and devise unto my Son Hendricus and to his heirs and assigns forever All those Lands tenements and hereditaments Situate at Asshokan in the Township of Marbletown which I have inherited by my wife Together with all and singular the hereditaments and appurtenances unto the same belonging or in any wise appertaining To have and to hold the said Lands Tenements and hereditaments with the appurtenances unto my said Son Hendricus and to his heirs and assigns to the only proper use and behoof of my said Son Hendricus his heirs and assigns forever. I Give and bequeath unto my dauther Lena Two milch cows and two sheep the choice out of my Flocks as also so much of my household furniture as she shall think proper to take to and for her own proper use benefit and behoof before any division of my personal Estate be made. Also, it is my will and I do hereby order and direct that my said two Sons Thomas and Jochem their heirs Executors or administrators out of the Estate hereby devised and bequeathed to them, Do and shall well and sufficiently Maintain and keep my said daugther Lena at any place she shall Elect with competent Meat, Drink and Cloathing of all sorts, washing lodging, mending and all other necessaries of life suitable for such a person during her natural lifetime and further it is my will that my said two Sons Thomas and Jochem Shall bear an Equal burden of the same. Provided always and it is my Will that if my said two sons Thomas and Jochem or either of them or their heirs Executors or Administrators shall neglect of refuse to maintain my said dauthter Lena as aforesaid or shall neglect or refuse to do such things as is hereby made incumbent upon them towards the same then and in such case they or any of them so neglecting or refusing as aforesaid shall be forever thereafter bared and disinherited of all and Singular the Estate herein before given and devised unto them, and then I give and devise the same to my said daughter Lena and to her heirs and and assigns forever. I Give and bequeath unto my said Son Jochem the Weavers Loom with its appurtenances and the Fan or wind mill also to be delivered to him before any division of my personal Estate be made. All the Rest and Residue of my personal Estate whatsoever I Give and bequeath the same unto four of my children to wit, Thomas, Jochem and Hendricus and my daughter Catharina the wife of Lodewick Schoonmaker, to be equally divided amongst them share and share alike that is to each of them the one equal fourth part thereof To have and to hold the same to my said four children their heirs and assigns forever. Item the sum of Four Hundred pounds above reserved to be paid by my said two sons Thomas and Jochem out of the Estate hereby given to them. I Give and bequeath the same unto my said son Hendricus and daughter Catharina as a legacy that is the sum of two hundred pounds to my said Son Hendricus and to his heirs and assigns forever, and the sum of two hundred pounds the residue of the said sum of four hundred pounds to my said daughter Catharina, the wife of Lodewick Schoomaker and to their heirs and assigns forever. And I do hereby order and direct my said two Sons Thomas and Jochem their heirs Executors or Administrators to pay or cause to be paid each of them the sum of two hundred pounds Good and lawful money as aforesaid, unto my said Son Hendricus and daughter Catharina at or before the expiration of two full years after my decease. And Lastly, I do hereby Constitute and appoint my said two Sons Thomas and Jochem to be Executors of this my last Will and Testament in trust for the intents and purposes in this my Will contained desiring them to see the same performed accordingly Hereby Revoking and disannulling all former and other Wills or Testaments by me made, allowing and declaring this only to be my Last Will and Testament. In Witness whereof I the said Daniel Schoonmaker have to this my last will and testament set my hand and Seal the day and year first above written- Daniel Schoonmaker DS Signed Sealed and declared by the said Daniel Schoonmaker to be his last Will and Testament in the presence of us whose names are hereunto Subscribed as Witnesses at the request and in the presence of the Testator - Note the word "Tract" of the 26th line of the first page and the word "and" of the 7th line of the fourth page being first Enterlined Nich. Be it Remembered that on the fourth day of November in the year of our Lord one thousand seven hundred and ninety one personally came and appreared before me Joseph Gasherie Surrogate of the said County, Dirck Wesbrook of Rochester in the said County Esquire and Nicholas Vanderlyn of Kingston in the said County yeoman and being duly sworn on their oaths declared that they and each of them did see Daniel Schoonmaker sign and seal the annexed written instrument purporting to be the will of the said Daniel Schoonmaker, bearing date the tenth day of July in the year of our Lord one thousand seven hundred and eighty eight and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said Daniel Schoonmaker was of sound diposing mind and memory to the best of the knowledge and belief of them the deponents and that Jacob Coddington together with the deponents subscribed the said will as witnesses thereto in the Testators presence. Joseph Gatherie Surrogate The People of the State of New York by the Grace of God, Free and Independent, To all to whom these presents shall come or may concern send Greeting. Know ye That at Ulster County on the fourth day of November last past before Joseph Gasherie Esq. Surrogate of our said County the last Will and Testament of Daniel Schoonmaker deceased / a Copy whereof is hereunto annexed / was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his Death Goods Chattels or Credits within this state by means whereof the proving and registering the said Will and the granting Administration of all and Singular the said Goods Chattels and Credits and also the auditing allowing and final discharging the Account thereof doth belong unto us. The Administration of all and Singular the Goods Chattles and Credits of the said deceased and any way concerning his Will is granted unto Thomas Schoonmaker.. and Jochem D. Schoonmaker, the executors in the said Will named they being first duly sworn well and faithfully to Administer the same and to make and exhibit a true and perfect Inventory of all and singular the said Goods Chattels and Credits and also to render a just and true account thereof when thereof unto required. In Testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed. Witness Joseph Gasherie Esquire Surrogate of the said County at Kingston the fourteenth day of December in the year of our Lord one thousand seven hundred and ninety one and of our Independence the sixteenth. Joseph Gasherie Surrogate The preceeding is a true copy of the original Will of Daniel Schoonmaker deceased also the the certificate of the proof thereof and also of the letters Testamentory. Note the words "I recommend" in the 10th line of the 274 page and "and" in the 30th line of 276 page being interlined. Joseph Gasherie Surrogate Additional Comments: I have entered this Will as faithfully as I could keeping misspelled words intact. The Will was sadly lacking in punctuation and paragraphing. There were upper case letters throughout in seemingly inappropriate places.
