Page 1 Written: January 25, 1787 Probated: May 15, 1787 File contributed for use in USGenWeb Archives by: Teresa Culver tbc8@cornell.edu May 25, 2007, 10:33 pm "In the name of God amen, I Jan Van Aken of the township of Kinston in Ulster County and State of New York, being weak in body but of sound memory blessed God Do this twenty fifth day of January in the year of our Lord one thousand seven hundred and eighty seven, make this my last will and testament in manner following, first I give unto my five sons, namely Peter, Johannis, Abraham, Jacob and Benjamin all my real estate now in my possession to be by them equally divided share and share alike, their heirs and assigns forever, with this condition that my sons Peter, Johannis, Abraham, Jacob and Benjamin shall in equal proportion and in a Christian manner maintain my Daughter Bushe during her natural life. Item. I give unto my grand child Abraham's son Jan three bonds of Leurs Hogg in my possession and also my great bible and my gun. Item, I give unto my grand child, Isaac's son, Johannis one bond of Abraham Van Wagene Junr and one bond of Simon Lefever, if the interest is not paid annually then they shall be obliged to give a new bond for principal and the interest every three years. Item I give unto my five sons Peter, Johannis, Abraham, Jacob and Benjamin the rest of my Bonds and notes if any there should be after my decease Item I give unto my two Daughters Mary and Sara all my moveables within my house (except what I will otherwise direct) and also each one hundred and twenty pounds in continental Dollars. Item I give unto my son Peter my pleasure slay Item I give unto my five sons above named all my wearing apparel to be equally divided among them Item if my grand child Isaac son Johannis should die before he is twenty one years old then what I made him shall go to my grand child Abraham's son Jan. Item I do hereby constituted and ordain my three sons Peter Abraham and Benjamin my Executors of this my last will and testament in trust for the intents and meaning thereof and that all my just debts shall be paid of if any there should be and further that my executors shall shall bury me in a Christian like manner without any pomp Jan Van Aken Signed, sealed and delivered by the said Jan Van Aken for his last will and testament in presence of us who when present at the signing and sealing thereof Petrus Smedes, Arie [?] Van Vliet, Johannis I. [or J] Dubois ..Ulster County Ls Be it remembered that on the tenth day of May in the year of our Lord, one thousand seven hundred and eighty seven personally came and appeared before me Joseph Gasherie Surrogate of the said county, Arie Van Vliet of Kingston in the said county, yeoman and Johannis I. [or J] Dubois of the same place Miller, and being duly sworn on their oaths declared that they and each of them did see Jan Van Aken sign and seal the within written instrument purporting to be the will of the said Jan Van Aken, bearing date the twenty fifth day of January in the year of our Lord one thousand seven hundred and eighty seven and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said Jan Van Aken was of sound disposing mind and memory to the best of the knowledge and belief of them the Deponents and that Petrus Smedes together with the Deponents subscribed the said will as witnesses thereto in the testators presence, Joseph Gasherie Surrogate The proceeding is a true copy of the Original Will of Jan Van Aken deceased and of the certificate of the proof thereof Joseph Gasherie Surrogate The People of the State of New York by the grace of God free and independent: To all to whom these presents shall come or may concern send greeting, Know ye that at Ulster County on the tenth day of this instant before Joseph Gasherie ..Surrogate of our said County the last will and testament of Jan Van Aken deceased ( a copy whereof is hereunto annexed ) was proved and is now approved and allowed of by us, and the said deceased having wilst he lived, and at the time of his Death goods chattels or credits within this state by means whereof the proving [word or two] registering the said will and the granting administration of all [and] singular the said goods, Chattels and credits and also the [two words] allowing and final discharging the account thereof doth belong [to] us; the administration of all and singular the Goods, chattels and credits of the said deceased, and any way concerning his Will is granted unto Peter Van Aken, Abraham Van Aken, and Benjamin Van Aken Executors in the said will named they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the [word] goods chattels and credits, and also to render just and true account thereof when thereunto required, In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed.
