Transcribed by Teresa Culver The last will and Testament of David Auchmoedy of the Town of New Paltz in the County of Ulster and State of New York. I David Auchmoedy considering the uncertainty of this mortal life, and being of sound mind and memory blessed be almighty God for the same, do make and publish this my last will and Testament in manner and form following that is to say, first I order and direct that my funeral charges and all my Just Debts be paid out of my personal estate by my Executors herein after named_ Item I give and bequeath unto my beloved wife Maritje, thirty dollars to be paid yearly by my six sons James, John, Peter, David, Abraham, and Levi each one sixth part on the first day of May in every year, during her natural life. I also give and bequeath unto my said wife, one cow, and one bed with the beding thereunto belonging Item I give and bequeath to my Eldest Son James Auchmoedy one sheep as his birth right. I also give and bequeath to my said son James, eighty seven dollars and fifty cents, to be paid by my son David Auchmoedy, one year after my decease. Item I give and bequeath to my son John Auchmoedy eighty seven dollars and fifty cents to be paid by my son David one year after my decease. Item I give devise and bequeath to my son Peter Auchmoedy, all my right and Title in lot Number one, in lot Number four, in the second Tier of lots in the Paltz Patent in the North division: called a grad tier lot to have and to hold, to my son Peter, and to his heirs and assigns forever. I also give and bequeath to my said son Peter eighty seven dollars and fifty cents, to be paid by my son David, one year after my Decease. Item I give devise and bequeath to my son David Auchmoedy the lot and farm with the appurtenances thereunto belonging whereon I now live and dwell together with my right Title and possession in the Crispel lot number nine Joining the said farm to have and to hold to my said son David and to his heirs and assigns forever. I also give and bequeath to my said son David the crop of grain, or hay which shall then at my decease, be either in the silo, in the barn or house. I further give to my son David, one span or pair of horse, my wagon and harness one Iron shad Ray (??), one plow, one harrow, one fine feather bed one dresser, one Iron pot, one rooster, two cows, one bull and three sheep, all of which the above articles he now claims as his own. Item I give devise and bequeath to my son Abraham Auchmoedy Lot Number Nine in lot Number four in the Plattebinne Water division containing about seven and an half acres, to have and to hold, the said lot of land, to my said son Abraham, and to his heirs and assigns forever. I also give and bequeath to my said son Abraham fifty dollars, to be paid by my son David, one year after my decease. Item I give devise and bequeath, to my son Levi, all my right Title and possession in lot number nine, one of the three mile, or River lots, in the North division, to have and to hold, to my said son Levi and to his heirs and assigns, forever. I also give and bequeath to my said son Levi eighty seven dollars, and fifty cents, to be paid , by my son David one year after my decease_ Item I give and bequeath to my daughter Helena, the wife of William Smith the Sum of fifty dollar, to be paid by my son David, one year after my decease_ All the remainder of my land in the Town of New Paltz or else where, and also all the remainder and residue of my personal Estate which I have not heretofore devised and bequeathed I desire and direct that the same shall be equally divided amongst my sons and daughters, share and share alike. And lastly I nominate and appoint my eldest son James Auchmoedy, my son in law William Smith and my friend Isaac Lefever my sole Executors, of this my last will and Testament hereby revoking all former wills by me made_ In witness whereof I have hereunto set my hand and seal, the seventh day of March one thousand eight hundred and nine_ _ _ Signed sealed published and declared by the above named David Auchmoedy David Auchmoedy LS to be his Last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the Testator _ _ _ Evert Blashan William Crosher William his mark Clark Ulster County Ls: Be it remembered that on the second day of January in the year one thousand eight hundred and Ten personally came and appeared before me David Brodhead Junior Surrogate of said County William Crosher who being duly sworn on his oath declared that he did see David Auchmoedy sign and seal the preceeding written instrument purporting to be the will of the said David Auchmoedy bearing date the seventh day of March in the year one thousand eight hundred and nine and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said David Auchmoedy was of sound disposing mind and memory to the best of the knowledge and belief of him the Deponent. And that Evert Blasham and William Clark together with the said Deponent severally subscribed the said Will as Witnesses thereto in the Testators presence_ Also personally appeared before me James Auchmoedy William Smith and Isaac Lefever Executors named in the preceeding will and were duly sworn to the True Execution and performance of the Said Will _ _ _ Daniel Brodhead Junr The People of the State of New York by the grace of God free and Independent To all to whom these presents shall come or may concern send greeting: Know ye that at Ulster County on the second day of January instant before Daniel Brodhead Junior Esq. Surrogate of our said County the last will and Testament of David Auchmoedy deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death goods chattles or credits within this State by means whereof the proving and registering the said will, and the granting administration of all and singular the said goods, chattles, and credits and also the auditing, allowing and finally discharging the account thereof, doth belong unto us the administration of all and singular the goods chattles and credits of the said deceased and any way concerning his Will is granted unto James Auchmoedy William Smith and Isaac Lefever Executors in the said Will named, they being first duly sworn well and faithfully to administer the same, and to make and exhibit a True and perfect Inventory of all and singular the said goods, chattles, and credits and also to render a Just and True account thereof when thereunto required_ In Testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed_ Witness Daniel Brodhead Junior Esq.
