Rather difficult to read, and punctuation is very difficult to interpret. Transcribed by Teresa Culver In the name of God Amen I John DeGraaf of Kyn Esopus and being weak in body but of sound memory (blessed by God) do this day the 3rd September in the year 1798 make & publish this my last will & Testament in manner following, That is to say First I give unto my oldest Son John my Gun as a free gift for his birthright. In the next reare(?) I give to my dear wife Annatje, two yoks of oxen & twenty three pounds being my share in a bond against Solomon Waring to be wholly at her disposal I also ordain that the remainder in full posesion(?) of all my estate real & personal so long as she remain my widow no division shall be made before her decease If her decease should happen before my youngest son is come to age the division shall be made then & not before I give also unto my five sons all my real estate i.e. lands & tenements whereof I shall dies seized in possession uversion(?) or remainder to be equally divided between them together with one cow (or plow?) harrow wagon & windmill provided my three younger sons do reimburse unto John the thirty six pounds & William the sum of forty six pounds lawful money by them paid to Bodowyn Terpenning each their equal part payable at the decease of my wife & if she should die before my youngest son shall come to age, the said money shall be payable then & not before I also order that in default of one(?) of any of children their portion both real & personal shall remain to be equally divided among the unmarried Unto my daughter Lena Annatje & Maria I give & bequeath each the Just and full sum of thirty pounds to become due immediately after the decease of my wife or when my son Jacob shall arrive the age of twenty one, if she should die before that time. I also order that all the rest of my goods and chattels or personal estate (except hat is above excepted, shall be equally divided between my three daughters after my wifes decease or before if she shall think proper Finally I make and ordain my three Sons John William & Jeremiah my Executors to take care & see that the intents & purposes in this my will contained be faithfully performed & executed after the expences of my decent burial & all honest expences be first settled- In witness whereof I the said John Degraaf have to this my Last will & Testament set my hand & seal this day & year above written John Degraaf L.S. Signed sealed & delivered by the said John Degraaf as & for his last will & Testament in the presence of us Albertus Schraber, Jon Delametter, Cornelius J. Delimater Ulster County Ls: Be it remembered that on the twenty fourth day of February in the year on thousand eight hundred and ten personally came and appeared before me Daniel Brodhead Junior Surrogate of said County Albertus Schraber who being duly sworn on his oath declared that he did see John Degraaf sign and seal the preceeding written instrument purporting to be his last will & Testament bearing date he third day of September in the year one thousand seven hundred and ninety eight that at the time thereof he the said John Degraaf was of sound disposing mind and memory to the best of the knowledge and belief of him the Deponent and that John Delametter and Cornelius J. Delamater together with the said Deponent severally subscribed the said Will as Witnesses thereto in the Testators presence _ Also personally appeared before me William DeGraaf and Jeremiah Degraaf Executors named in the preceeding will and were duly sworn to the True Execution and performance of the said Will Daniel Brodhead, Junr The People of the State of New York by the grace of God free and Independent To all to whom these presents shall come or may concern send greeting Know ye that at Ulster County on the twenty fourth day of February instant before Daniel Brodhead Junior Esq. Surrogate of our said County the last will and Testament of John Degraf deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed ? by us, and the said deceased having whilst he lived and at the time of his death goods chattles or credits within this State by means whereof the proving and Registering the said will and the granting administration of all and singular the said goods, chattels, and credits and also the auditing, allowing and finally discharging the account thereof, doth belong unto us: the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his Will is granted unto William Degraaf & Jeremiah Degraaf Executors in the said Will named, they being first duly sworn well and faithfully to administer the same, and to make and exhibit a True and perfect Inventory of all and singular the said goods, chattels, and credits and also to render a Just and True account thereof when thereunto required_In Testimony whereof we have caused the seal of office of our said County Surrogate to be hereunto affixed_ Witness Daniel Brodhead Junior Esq.
