This first day of November in the year of our Lord one thousand eight hundred, I Jochem Schoonmaker of the town of Rochester in Ulster county and State of New York, being in health of body and of sound and perfect mind memory and understanding, thanks be given to Almighty God but considering the uncertainty of this transitory life, and that we must all yield unto death when it shall please God to call, Do make and ordain This my last Will and Testament in manner following. First and principally I recommend my Soul into the hands of God who gave it, and my body I recommend to the Earth to be buried in a decent manner at the discretion of my Executors, nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God. And as touching such worldly Estate wherewith I am blessed in this life, I give devise and dispose of the same in the following manner and form. Item It is my will, and I do hereby order and direct, that all my just Debts and funeral expences be paid and discharged out of my personal Estate before any other disposition thereof be made. I give and bequeath unto my true and loving Wife Helena a young Negro Girl named Tar, two milk Cows, the choice of my stock, two Beads, Bedsteads with all its clothing and appurtenances, and so much of my household furniture as my said Wife shall think proper to take, all which said property I give to my Wife to enjoy during her natural lifetime so long as she shall remain a Widow in my name, afterwards to be equally divided between my two daughters, to wit Mary the Wife of Henry Schoonmaker and Margaret the Wife of Daniel Hasbrouck Junior. I also give and bequeath unto my said Wife, one Room(?) the choice of my dwelling house, together with the liberty of the Cellar door yard, a spot of ground near the dwelling house suitable for a garden, and so many apples or other fruit as she shall need, all which last mentioned priviledges my said wife shall enjoy during her lifetime or so long as she shall remain a Widow in my name. And I do also further Give and bequeath unto my said Wife Helena Twenty pounds lawful money of the State of New York yearly. To be paid unto her by my daughter Mary yearly and every year during the lifetime of my said Wife, or so long as she shall remain a Widow in my name, and I do hereby make my Real Estate chargable with the yearly sum of twenty pounds or the payment thereof unto my said Wife as aforesaid. And that my said daughter Mary shall find and provide, or cause to be provided a competent quantity of firewood for her use, and keeping for her two cows with hay and pasture during the time aforesaid. My Negro man Slave Tom and my Negro wench Sara, I do hereby manumit and Release from being Slaves immediately, after my decease in consideration of the faithful services which they have rendered me. I give and bequeath unto my said daughter Mary, my Negro man Slave Pete, two Horses and Eight Sheep the choice of my stock and my Weaving Loom with all its appurtenances. To have and to hold the same unto my said daughter Mary her Heirs and assigns forever. All the rest and residue of my personal Estate, I give and bequeath unto my my said two daughters Mary and Margaret to be equally divided between them share and share alike; To have and to hold the same unto my said two daughters Mary and Margaret their heirs and asssigns forever. I Give and bequeath unto my said daughter Margaret the sum of Four hundred pounds lawful money of the State of New York, as a Legacy to be paid unto her, or her Heirs or assigns by my said daughter Mary at different payments in manner following to wit, one hundred pounds thereof at the expiration of one year after the decease of my said Wife if she shall survive me, otherwise at the expiration of one year after my decease and the further sum of one hundred pounds thereof at the expiration of every successive year thereafter so that the last payment be made at the end of three years from the time limited for the first payment. And I do hereby make my Real Estate chargable with the said sum of Four hundred pounds, or the payment thereof, in manner aforesaid unto my said daughter Margaret. To have and to hold the said sum of Four hundred pounds unto my said daughter Margaret, her heirs or assigns forever. And whereas, by the last will and Testament of my father, Daniel Schoonmaker, late of Rochester deceased, the Estate whereof I am now possessed is charged with a certain portion of the Expenses to support and maintain my Sister Helena, therefore it is my will and I do hereby order and direct that my said daughter Mary shall bear that charge for the maintenance and support of my said Sister Helena in like as I am bound to do during her natural lifetime. All my Lands Tenements and Hereditaments whatsover with the buildings and appurtenances which compose my Real Estate wheresoever the same may be situated, I give and devise the same unto my said daughter Mary subject nevertheless to the incumbrances herein before mentioned. To have and to hold all and singular my Lands Tenements and Hereditaments with the appurtenances unto my said daughter Mary, her heirs and assigns; To the only proper use, benefit and behoof of my said daughter Mary her heirs and assigns forever. And whereas I have lately been sued in an Action of Ejectment for a certain part of the Lands which I now possess and which said suit is still depending and undetermined in the supreme Court of the people of the State of New York Therefore, in in the case the Plaintiffs in that suit should recover, It is my will and I do hereby order and direct that my said daughter Margaret shall pay or reimburse unto my said dauther Mary the one half of all such costs, expenses or loss of property which she may sustain by reason of such recovery, so as not to exceed the sum of Two hundred pounds, any thing herein before contained to the contrary thereof in any wise notwithstanding. And Lastly I do hereby nominate and appoint my beloved Wife Helena, Executrix, and my two Sons in law Henry Schoonmaker and Daniel Hasbrouck, Junior, Executors of this my last will and Testament, in trust for the intents and purposes therein contained and I request them to see the same performed accordingly; hereby revoking all former Wills and Testaments by me made, allowing and declaring this only to be my last will and Testament. In Witness whereof I the said Jochem Schoonmaker to this my last Will and Testament have set my hand and Seal the day and year herein first above written. Jochem Schoonmaker Signed Sealed, published and declared by the said Jochem Schoonmaker to be his last Will and Testament in the presence of us whose names are hereunto subscribed as Witnesses at the request and in the presence of the Testator. Be it remembered that on the sixth day of August in the year of our Lord one thousand eight hundred and four personally came and appeared before me Joseph Gasherie Surrogate of the said county Daniel L. Schoonmaker and Jacob Coddington of the town of Rochester in the said county yeomen and being duly sworn on their oaths declared that they did see Jochem Schoonmaker sign and Seal the annexed will purporting to be the will of the said Jochem Schoonmaker bearing the date of the first day of November one thousand eight hundred and heard him publish and declare the same as and for his last will and Testament that at the time thereof he the said Jochem Schoonmaker was of sound disposing mind and memory to the best of the knowledge and belief of them the deponents and the said deponents together with Joakim Schoonmaker subscribed the said will as witnesses thereto in the Testators presence and Henry Schoonmaker and Daniel Hasbrouck Junior executors named in the annexed will likewise appeared before me and were severally sworn to the true execution and performances of the annexed will by taking the usual oath of an executor. Joseph Gasherie Surrogate The People of the State of New York by the Grace of God free and independent, To All to whom these presents shall come, or may concern, send Greeting; Know ye, that Ulster county on the sixth day of August instant before Joseph Gasherie Esquire Surrogate of our said county, the last Will and Testament of Jochem Schoonmaker deceased/ a Copy whereof is hereunto annexed was proved , and is now approved and allowed of by us, and the said deceased having whilst he lived and at the time of his death goods chattels or Credits within the State by means whereof the proving and registering the said Will, and the granting administration of all and singular the said goods chattels and credits, and also the auditing; allowing and final discharging the account thereof doth belong unto us; the administration of all and singular the goods chattels and credits of the said deceased, and any way concerning his will is granted unto Henry Schoonmaker and Daniel Hasbrouck Junior Executors in the said Will named they being first duly sworn well and faithfully to administer the same, and to make and exhibit true and perfect Inventory of all and singular the said goods chattels and credits, and also to render a just and true account thereof when thereunto required. In Testimony whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed.
