I Peter Jansen of the Town of Marbletown in the County of Ulster and State of New York, being in good health and of sound and perfect disposing mind and memory blessed be God therefore do this thirtieth day of January in the Year of our Lord Christ One Thousand Eight Hundred and Twenty Eight make and publish this as my last Will and Testament in manner and form following that is to say ; First I give and devise All the Real Estate Where of I am ( s????) and possessed of unto my loving wife Catharine during the time she remains my widow and after her decease or remarriage. I dispose there of as follows. Secondly after my said wifes decease or remarriage I give devise and bequeath unto my son Jacob and his heirs I assign All my lands situate in the Town of Wawasink and also a lot lying at the place called Green Field in the Town of Wawasink aforesaid together with the hereditaments and appurtenances to the same belonging providing nevertheless and upon the condition that my said son Jacob shall pay unto my daughter Maria the sum of Four hundred dollars in two equal payments, that is to say the sum of Two hundred dollars in One year after my wifes decease or remarriage and the remaining Two hundred dollars at the time Two Years thereafter. I also give and bequeath unto my said son Jacob All the Farming utensils Horses Cattle which are now in his possession. Thirdly I Give Devise and Bequeath unto my sons Henry and Moses and to their respective heirs and assigned forever All the land I own in the town of Marbletown aforesaid after my said wifes decease or remarriage together with all and singular the hereditaments and appurtenances thereunto there unto belonging to be equally divided between them Share and Share alike provided nevertheless and on the condition that they pay unto my said daughter Maria the sum of Eight hundred dollars that is to say each of the said Henry and Moses to pay unto her the sum of Four hundred dollars that is to say each to pay Two hundred dollars unto her in One year after my said wifes decease or remarriage and each of them the further sum of Two hundred dollars at the expiration of Two years thereafter. I also give and Bequeath unto my said sons Henry & Moses to each of them Five horses a pair of oxen and two mulch cows the choice there of. Also all my farming utensils whatsosay Excepting what I have herein before given to my son Jacob Fourthly I give and bequeath unto my said sons Jacob, Henry, and Moses to each of them share and share alike All my outstanding notes Bonds and book accounts. Fifthly I do hereby empower and authorize my Executrix and Executors hereinafter named to sell grant and bargain for a certain lot of land situate in the Town of Olive belonging to me which is distinguished by lot # 31 Containing twenty five and a half acres And execute to the purchase or purchases thereof good ample and sufficient conveyances in the law the mores there fore arising Shall be applied towards the payment of my just debts and that the remainder of my debts shall be paid by my said there sons equally. Sixthly I give and bequeath unto my said daughter Maria the choice of my Beds, unreadable, and everything there unto belonging together with sufficient covering covers of every description fitting for summer and winter also my Mahogany Table to her and her heirs and assigns forever Seventhly All my the rest and residue of my personal property which is not Herein otherwise disposed of. I give and bequeath unto my said there sons and daughter to be equally divided between them share and share alike. Lastly I do hereby nominate constitute authorize & appoint my wife Catharine Executrix and my sons Jacob & Henry Executors to this my last will and Testament hereby revoking and making void all former Wills by me made. Note on the 22nd line of the first page the word Dollars first utilized before the Execution In witness there of. Ulster County ss. Henry T Jansen of the town of Marbletown in the said County of Ulster being duly sworn and examined doth depose and say that the deponent was well acquainted with Peter Jansen late of the Town of Marbletown in the County of Ulster deceased. That the deponent was present as a witness and did see the said Peter Jansen subscribe at the end there of the instrument now produced and shown to the deponent purporting to be the last will and Testament of said deceased bearing date the thirtieth day of January in the year of our Lord One thousand eight hundred & twenty Eight. That the said testator at the same time declared the instrument so subscribe by him to be his last will and Testament . That thereupon the deponent and Jacob Irwin & Andries I Roosa subscribe his name at the end thereof as a witness thereto at the request of the Testator and in his presence and that the said Testator at the time of Executing and publishing the said last will and Testament was of full age of sound mind and memory in all respects competent to devise Real Estate and not under any restraint. D Ostrander Surrogate Ulster County Surrogates Office ss I Jonathan D Ostrander Surrogate of said County do certify that on the fifth day of March in the Year of our Lord One thousand Eight hundred and thirty two the within last will and Testament of Peter Jansen late of the town of Marbletown in said County deceased had been admitted to probate by me and duly proved according to the provisions of the statutes in such cases made and provided as the last will and Testament of Real and personal Estate of the said deceased which said last Will and Testament and the proofs and examinations taken thereon are recorded in the office . The testimony whereof I the said Surrogate have hereunto set my hand and affixed my official seal this fifth day of March in the Year of our Lord One thousand eight hundred and thirty two. Jon D Ostrander surrogate Ulster County Surrogates office , ss I Jonathan D Ostrander Surrogate of said County do certify that on tenth day of April in the year of our Lord One thousand Eight hundred and thirty two before me the said surrogate personally appeared Jacob Jansen and Henry P Jansen the executors .. In the last will and Testament of Peter Jansen deceased named and took and subscribed an Oath or affirmation faithfully and honestly to discharge the duties of such executors .. According to Law and letters testimony thereon were there and there granted to said Executors. In testimony whereof I the said Surrogate have hereunto set my hand & affixed my official seal this Tenth day of April in the year of our Lord One thousand Eight hundred and thirty two. Jon. D Ostrander Surrogate Ulster County Surrogates office ss I certify this preceding to be a true record of the Last will and Testament of Real and personal Estate of Peter Jansen late of Marbletown deceased and of the proofs and examinations taken thereof by me - and of the certificates of probate and the granting(?) of Letters (unreadable) thereof. The word "Marbletown" in the deposition of Andries I Roosa underlined. Jon. D. Ostrander Surrogate NOTES: I copied the will word for word the best I could. I reread it many times even with a magnifying glass trying to figure out each word. There were still a few I just could not make out. Peter Jansen was my maternal ggg-grandfather , he died Jan. 4 1832 ; His wife was Catharine Bevier , she died Nov. 10 1842. Moses Jansen was my gg- grandfather , he died June 10 1877. I have pictures of Peter , Catharine , Moses , Anna Maria ,and Henry P. Jansen's headstones taken at Marbletown Reformed Dutch Church Ground on Rte. 209 . In the book " Old Gravestones of Ulster County , NY " Catharine is mistakenly listed under her maiden name Bevier , when her headstone clearly reads " In memory of CATHARINE BEVIER relict of Perter Jansen dec'd who died Nov 10 1842 74 yrs. 3 mo. 13 d's . " I believe Jacob Jansen may be buried at the New Paltz Rural Cemetery . I believe Henry T. Jansen is Peters nephew .
