Schoonmaker of the town of Rochester in the County of Ulster being in good health and of perfect mind and memory thanks be given unto God calling into regard the mortality of my body and knowing that it appointed for all men once to die do make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hand of Almighty God that gave it and my body I recommend to the earth to be buried in decent Christian burial at the discretion of my Executors the same again by the mighty power of God and as touching such worldly estate wherwith it has pleased God to bless me in this life I give an dispose of the same in the following manner and form. First I give and bequest unto my three sons Jacob H.B., Johannes Decker and Benjamin and to my step daughter Sarah all my wearing apparrel. Also my beds, bed stead and covering both woolen and linen with all their appurtenances one fourth part to each of them. Secondly, I give and bequeath unto my three sons Jacob Hornbeck, Johannes Decker and Benjamin all the remainder of my personal Estate to be equally divided between them that is to say one third part to Jacob Hornbeck, one third part of Johannes Decker and one third part to Benjamin and I also constitute make and ordain my three sons Jacob Hornbeck, Johannes Decker and Benjamin executors of this my last will and testament. In witness whereof I have herewith set my hand and seal this sixteenth day of May in the year of our Lord One thousand eight hundred and thirty three. The word fourth was obliterated in the 21 and 22 lines from the top and the word three were interlined immediately above both Signed Sealed and declared by the said Maria Schoonmaker as her last will and testament in her presence and in the presence of each other have hereunto subscribed our names Abm T.E. Dewitt being duly sworn doth dispose and say that he saw the writer of the will within named that the same was after being written sealed up and kept in the possession of this deponent until the same was delivered to Johannes D. Schoonmaker being duly sworn doth depose and say that the will within named was by me handed to this court for probate and is as it was when it was delivered to me by the within named witness Sworn this 3rd July 1840 before me James N. Mitchell, Surrogate Johannes D. Schoonmaker State of New Yorok Ulster Surrogate Courts In the Matter of Proving the Last Will and testament of Maria Schoonmaker deceased Ulster County S.S. Be it remembered that on this 3rd day of July in the year one thousand eight hundred and forty before James N. Mitchell Surrogate of the County of Ulster personally appeared Abraham T.E. Dewitt who being by the said Surrogate duly sworn and examined doth depose and say that this deponent was well acquainted with Maria Schoonmaker deceased, that he was present as a witness and did see the said Maria Schoonmaker deceased subscribe at the end thereof the instrument now produced and shown to the deponent purporting to be the last will and testament of the said Maria Schoonmaker late of the Town of Rochester deceased bearing date the 16 day of May in the year one thousand eight hundred and thirty three that such subscription was made by the said testatrix in the presence of this deponent and the said Maria Rosekranse and Sarah DeWitt Signed their names at the end thereof at the request of said testatrix and that said testatrix at the time of executing and publishing the said last will and testament was of full age, of sound mind and memory and not under any restraints. Be it remembered that on the 3rd day of July in the year of our Lord one thousand eight hundred and forty the last will and testament of Maria Schoonmaker late of the town of Rochester in the County of Ulster, deceased bearing date the 16th day of May one thousand eight hundred and thirty three being the written instrument of the said deceased in hereunto annexed and duly admitted to probate by the Surrogate of said County of Ulster, according to ______ as and for the last will and testament of the personal estate of the said deceased; which said last will and testament, and the probate thereof are recorded in this office. In testamony whereof the said surrogate hath hereunto set his hand and affixed his seal of office this 3rd day of July in the year one thousand eight hundred and forty Jame N. Be it remembered that on the 3rd day of July in the year of our Lord one thousand eight hundred and forty before the surrogate of said County of Ulster personally appeared Johannas D. Schoonmaker, Jacob H.B. Schoonmaker and Benjamin Schoonmaker executors in the last will and testament of Maria Schoonmaker deceased, named and took and subscribed an oath faithfully and honestly to discharge the duties of such executors according to Law and Letters testamentary thereon which are duly recorded in this were then and then granted to said Executors. Testimony whereof the Said Surrogate hath hereunto set his hand and affixed his seal of office this 3rd day of July in the year one thousand eight hundred and forty James N.
