Present: J. Westbrook, Jr. Surrogate The Last Will and Testament of Jacob Bensel deceased was admitted to probate and proved as a will of real and personal estate which together with the proofs taken is in relation thereto are as follows: In the name of God, amen. I Jacob Bensel, of the town of Shawangunk, in the county of Ulster and the State of New York of the age of Seventy-seven years and being of sound mind and memory do make, publish and declare this my last will and testament in manner following, that is to say: First: - I give and bequeathe to my wife Sally the use and controll of my Real Estate, the Farm on which I now live for her natural life time and also as much of the Househould goods and Furniture as she shall wish to reserve to her own use and to dispose of in such manner as she shall see fit, and the Rest, Residue and Remainder of my personal Estate shall be appraised and disposed of or divided as follows: - Secondly: - I give and bequeath to my daughter, Louisa, Two Hundred dollars of my Personal Estate. Thirdly: - I give and bequeathe to my youngest daughter Emeline Four Hundred dollars of my Personal Estate. And the Rest, Residue and Remainder of my personal estate, if any there shall be after the reservation of my wife Sally, paying my funeral expenses and first the said Two Hundred dollars to my daughter Louisa, and secondly the said Four Hundred dollars to my said daughter Emeline, the same shall be equally divided among my five daughters: Margaret, Mabea, Sarah, Maria, Louisa and Emeline. Share and share alike and I further direct that so much of the said Four Hundred dollars hereby bequeathed to my daughter Emeline, as shall realised in money from the sale of such personal estate shall be invested by executors, hereinafter named until such time, as the said Emeline, shall get married or otherwise need the same, and she to receive the interest accruing on the same annually. Fourthly: - I give and devise to my son Robert all my Real Estate, the Farm on which I now live subject to the following encumbrances: - first, the life estate of my wife Sally, second, a mortgage held by David Mould on said Farm for one thousand dollars and thirdly, a note given by me to my daughter Margaret, which she now houlds against me, which I hereby direct him to pay or the same shall be a lein against the said Farm to have and to hould the same with the appurtenances and herediments there unto belonging after the death of my wife Sally forever. And lastly: - I do hereby appoint my son Marcus Bensel and C.A.J Hardenbergh the two Executors of this my last Will and testament; hereby Revocking all former wills by me made. In witness whereof I have hereunto set my hand and seal this nineteenth day of June, in the year of our Lord one thousand eight hundred and sixty five. Jacob Bensel The above instrument consisting of one sheet was at the date thereof declared to us by Jacob Bensel, the testator, therein mentioned to be his last will and testament and he at the same time acknowledged to us and each of us, that he had signed and sealed the same, and we therupon and at his request and in his presence and in the presence of each other, signed our names hereto as attesting witnesses John Raymond, residing at Shawangunk C.A.J. Hardenbergh, residing at Shawangunk In the Matter of Proving the Last Will and Testament of Jacob Bensel, deceased. Ulster County S.S. John Raymond and Cornelius A.J. Hardenbergh of the town of Shawangunk and County of Ulster, being first duly sworn in open Court on their oaths depose and say, that they are subscribing witnesses to the last will and testament of Jacob Bensel, late of the town of Shawangunk in the County of Ulster, deceased; and these deponents further say that the said deceased did, in the presence of these deponents, subscribe his name at the end of the instrument which is now here shown to these deponents and which purports to be the last will and testament of the said deceased, and which bears date the nineteenth day of June, in the year one thousand eight hundred and sixty-five; that the said deceased did at the time of subscribing his name to the same instrument aforesaid, declare the same to be his last will and testament that these deponents dis thereupon subscribe their own names at the end of the said instrument, as attending witnesses to the execution thereof, at the request of the said deceased, and in his presence, and in the presence of each other; that the said deceased, at the time of subscribing his names to the said instrument as aforesaid, was upward of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint, to the knowledge and belief of these deponents.
