Present Hon. D. M. DeWitt Surrogate. The last will and testament of Helena Van Vliet was admitted to probate and proved as a will of real and personal estate which together with the proofs in relations thereto are as follows. Helena Van Vleit of the town of Rochester County of Ulster & State of New York being of sound mind and memory do make, ordain, publish, and declare this to be my last will and testament , that is to say: First. After all my lawful debts are paid and discharged, I give, devise and bequeath unto my Husband Benjamin Van Vleit all my real estate situate in the town of Rochester aforesaid containing about twelve acres of land being the homestead on which I now reside and being the same land as described in deed from Joseph K. Hornbeck and wife to me dated October 10th, 1877 for his use and benefit to be disposed of at his death as he may direct. Likewise I make, constitute and appoint my Husband Benjamin Vanvleit to be executor of this my last Will and Testament, hereby revoking all former Wills by me made. In Witness whereof I have herewith subscribed my name and affixed my seal, the 25th day of July in the year of our Lord one thousand eight hundred and eighty five. Middagh) The above instrument consisting of 2 sheets was at the date thereof subscribed by Helena Vanvleit in the presence of us and each of us: She at the time of making such subscription acknowledge that she made the same and declared the said instrument so subscribed by her to be her last Will and Testament. Whereupon in then and there, at her request and in the presence and the presence of each other, subscribed our names as witnesses thereto. J. D. Winfield residing at Accord, NY Jno H. Middagh residing at Accord NY Sounty of Ulster Surrogates Court In the Matter of Province? the Last Will and Testament Of Helena Vanvleit deceased. Ulster County John D. Winfield and John H. Middagh of the town of Rochester Ulster County NY being first duty sworn in open court on their oaths depose and say that they are subscribing witnesses to the Last Will and Testament of Helena Van Vliet late of the town of Rochester in the County of Ulster deceased and these deponents further say that the said deceased vid in the presence of these deponents subscribe her name at the end of the instrument which is now here shown these deponents and which purports to be the Last Will and Testament of the said deceased and which bears date the 25th day of July in year one thousand eight hundred and eighty five that the said deceased vid. At the time of subscribing her name to the same instrument as aforesaid declare the same to be her last Will and Testament. That these deponents are thereupon subscribe their own names at the end of the said instrument, as attesting witnesses to the execution thereof at the request of the said deceased, and in her presence and in the presence of each other and the said deceased at the time of subscribing the her name to the said instrument as aforesaid was upwards of twenty one years of age. That she appeared to be of sound mind and memory and was not under restraint to the knowledge and belief of these deponents. Subscribed and sworn before me this 8th day of March 1886. J. D.
