The Last Will and Testament of Mary Connors In the name of God amen. I, Mary Connors of the Village of Glens Falls, Warren County, NY being of sound mind and memory, do make, publish and declare this my last will and testament, in manner following: First, I direct my Executor hereinafter named to pay all my just debts and funeral expenses. Second, I give, devise, and bequeath unto nephew Charles Edward Lapoint (who is commonly known and goes by the name of Charles Edward Connors) who has lived in my family from infancy, all my real and personal property of every name and nature and wherever situated, to be his forever. Lastly, I hereby constitute and appoint my said nephew Charles Edward Lapoint, commonly known as Charles Edward Connors, to be sole executor of this my last will and testament, hereby revoking all former wills by me made. In witness whereof, I have hereunto set my hand and seal this eleventh day of May, 1899. Mary Connors The above instrument consisting of one page, was at the date thereof signed, sealed, published and declared by the said Mary Connors, as and for her last will and testament, in presence of us who at her request and in her presence, and in the presence of each other, has subscribed our names as witnesses thereto. Bertha Larkin, residing at Glens Falls, Warren County, NY Surrogates Court State of New York County of Warren In the matter of proving the last will and testament of Mary Connors, deceased. County of Warren, ss: William M. Cameron and H. Bertha Larkin of Glens Falls in the County of Warren being first duly sworn in open court, doth depose and say, and each for himself deposes and says that he or she is a subscribing witness to the instrument now shown to them, purporting to be the last will and testament of Mary Connors, late of the town of Queensbury in the County of Warren, and bearing date the 11th day of May, one thousand eight hundred and ninety nine. That the said Mary Connors did in the presence of these deponents subscribe her name at the end of the said instrument and did thereupon declare the said instrument so subscribed to be her last will and testament, and this deponent did thereupon subscribe his or her name at the end of the said will, as an attesting witness thereto, in the presence of and at the request of the said testatrix. That the said Mary Connors was at the time aforesaid a citizen of the United States, above the age of twenty one years, of sound mind and memory, and was not under any restraint to the knowledge and information or belief of the deponent. Bertha Larkin County of Warren, ss: It appearing upon this proof duly taken in respect to the last will and testament of Mary Connors late of the town of Queensbury, Warren County deceased, that the said last was duly executed, that the said Mary Connors was at the time of executing the same competent to devise real and personal property and was not under any restraint. That the said last will and testament together with the proofs are hereby signed and certified to by me according to the provisions of the Record Statutes, this 19th day of June in the year one thousand eight hundred and ninety nine. Chr---t---, Surrogate In the matter of proving the last will and testament of Mary Connors, Deceased, The verified petition of Charles E. Lapoint named as executor in the will of Mary Connors late of Queensbury, Warren County, deceased, having been filed in this Court June 7, 1899, praying for the probate of said will, and a citation having therefrom been issued, directed to all the heirs and next of kin named in said petition, advisable this day, and the same having been returned with due proof of service thereof upon James Connors, Thomas Connors, Julia Moynihan the heirs and next of kin aforesaid, and the petitioners now appearing , whereupon such proceedings were had, that the proofs were duly taken, and the allegations of the parties appearing having been heard, and the Surrogate having inquired particularly into all the facts and circumstances, and being satisfied of the genuineness of the will and the validity of its execution, and the competency of the testatrix, and the probate of said will not having been contested. It is therefore adjudicated that the instrument offered for probate is the last will and testament of the said testatrix, and as such is valid as a will of real and personal property, and the same is hereby admitted to probate as a will of real and personal property and that letters testamentary be issued thereon to the executor Chas.
