Second I give and bequeath to my niece Phebe Wood Three hundred dollars in money also one comforter and quilt one rocking chair 6 maple chairs, 1 looking glass, in the setting room floor carpet on the setting room floor, also 9 dining plates, 9 tea plates, 2 white platters, 12 teacups and saucers, one large silver spoon, one maple table, 1 Butter knife, furthermore I give all my wearing apparel to Lydia Wood & Phebe Wood her sister to be divided equally between them to have and to hold forever for them & their heirs. Thirdly, I give and bequeath to Ida Austin one bed & pillows & straw bed, one beaureau, one wash bowl & pitcher & stand, 6 silver teaspoons, 1 large table spoon silver, to have and hold forever for her and her heirs. Fourthly, I give and bequeath to my niece Maryan Waters, one looking glass gilt frame, one tea table, one set of China dishes, six silver teaspoons, 1 cream spoon, one set of knives & forks with white handles, also my muff and firs, to have and to hold forever for her and her heirs. Fifthly, I give and bequeath to my nephew Charles W. Austin my brussell carpet & my eight day clock, 1 large silver spoon to have and hold forever for him & his heirs. Sixth, I give to my Nephew William Austin my dining room table, 1 bed room carpet, 1 large silver table spoon, six sofa chairs, 1 rocking chair, sofa to have and hold forever to him and his heirs. Seventh I give and bequeath to my husband James H. Austin my farm which I now live on in the town of Cambridge County of Washington State of New York supposed to contain 4 1/2 acres of land, to have and to hold forever, to him and his heirs also 1 large silver spoon. Furthermore and Likewise I make, constitute and appoint my husband James H. Austin to be executor of this my last Will & Testament, hereby revoking all known wills by me made. In Witness Whereof I have hereunto subscribed my name and affixed my seal the Twenty day of March in the year of our Lord one Thousand eight hundred and eighty three. Ruby Austin L. S. The above instrument consisting of one sheet was at the date thereof subscribed by her in the presence of us and each of us: She at the time of making such subscription acknowledged that she made the same and declared the said instrument so subscripted by her to be her last Will & Testament. Whereupon we then and there at her request and in her presence and the presence of each other, subscribed our names as Witnesses thereto. Ebenezer McLean residing at Jackson Washington Co., N.Y. Sarah McLean residing at Jackson Washington Co., N. Y. Surrogate's Court Washington county In the matter of proving } the last Will & Testament } of Ruby Austin, Deceased, } Washington County ss. Ebenezer McLean and Sarah McLean residing at Jackson in said County being duly sworn in open Court severally depose and say, that they were acquainted with the above named Ruby Austin in her lifetime: and that they and each of them were present and saw her subscribe her name at the end of the instrument in writing now produced and exhibited to them purporting to be the last Will and Testament of the said deceased bearing date the twentieth day of March day of March A. D. one thousand eight hundred & eighty three. That the said deceased at the time of subscribing her name as aforesaid published and declared the said instrument to be the last Will & Testament in the present of these deponents and of each of them and these deponents at the request of the said deceased and in her presence and in the presence of each other subscribed their names respectively thereto as witnesses to the execution thereof. That at the time of the execution thereof, the said deceased was a citizen of the United States above the age of twenty one years of sound disposing mind and memory and not under restraint to the best of the knowledge information and belief of these deponents. Hill Surrogate Additional Comments: Ruby's maiden name was Snell. She was first married to William Read of Washington county, N. Y., then to James H. Austin of Washington county, N. Y.. She did not have children with either husband.
