First, I order and direct that my just debts if any there be together with my funeral expenses be first paid out of my property. Secondly, I give & bequeath to my beloved wife Hetty Stead the place I now live on together with the appertenances there unto belonging and all the household furniture, one horse, one waggon [wagon] and harness, one cow, which furniture horse waggon cow & harness, to be at her own disposal and the place on which I now live during her natural life or as long as she remains my widow, and also I give my Said beloved wife the interest on a certain Mortgage which I hold against my Son Henry Stead (which Mortgage is of the same date of this Will) untill [until] Electa Stead Dennis my grand daughter is Eighteen years of age which will be seventeen years from the thirtieth day of this present month which interest is on the lot purchased of Henry Morris and on the amount of fourteen hundred Dollars which interest is to be paid on the first day of April of Each & every year as above: Thirdly - I give & bequeath unto the heirs of my Son William D. Stead one hundred Dollars. To my son Robert Stead one hundred Dollars. To my son Dodson Stead one hundred Dollars. To my daughter Mary Ann Crandle [Crandall] one hundred Dollars, and to the heirs of my daughter Sarah Emerson one hundred Dollars. Fourthly - I authorize and Empower my Executor hereinafter named to Sell and dispose of so much of my real or personal property or both as shall be sufficient to pay the above legacies within Eighteen month after my death. Fifthly - I give and bequeath to my son Henry Stead five hundred Dollars of the amount of the place which I this day sell to him which whole amount is nineteen hundred Dollars and the other fourteen hundred is Secured by mortgage as above, and at the time when Electa S. Dennis arrives at the age of Eighteen years one half of the Said mortgage or seven hundred Dollars to be paid to my Said Granddaughter Electa and the other half to belong to my son Henry Stead, but in case of the death of my son Henry without heirs his part shall belong to my granddaughter Electa S. Dennis or if Electa should die first without heirs, then her part shall belong to my son Henry, but in case both should die without heirs, then the property or fourteen hundred Dollars shall be equally divided between my first five children and their heirs as named above and the other half shall belong to Mary Shepherd and Harriet N. Swartwout and their heirs, children of my beloved wife by a former husband and the place on which I now live be equally divided between Henry Stead and Electa S. Dennis at the death of my beloved wife but in case of their death without heirs then to be divided as the mortgage to the other heirs. And lastly I hereby constitute and appoint my dear wife Hetty Stead Executrix and my Son Robert Stead and Peter Luyster Executors of this my last Will and Testament. In witness whereof I have hereunto set my hand and Seal this fifth day of January in the year of our Lord one thousand Eight hundred & forty nine. White, Greenwich Washington County N. Y. in the words one hundred and twenty Dollars of the above the words "and twenty" were erased at my request in five places. Henry Stead LS Moses H. Testimony County of Washington Surrogate's Court In the matter of proving the last Will & Testament of Henry Stead late of the Town of Greenwich in the County of Washington & State of New York deceased. Washington County LS: Jerome T. Mason of Greenwich aforesaid being first duly Sworn in open Court deposes and says that he was acquainted with the above named Henry Stead in his life time; And that he & Moses H. White the other Subscribing Witness to Said Will and Each of them were present and saw him Subscribe his name at the end of the instrument in writing now produced and exhibited to him purporting to be the last Will & Testament of the Said deceased, bearing date the Fifth day of January A. D. 1849. That the said deceased at the time of Subscribing his name as aforesaid published and declared the Said instrument to be his last Will & Testament in the presence of this deponent and Said Moses H. White and Each of them; And this deponent and Said Moses H. White at the request of the Said deceased and in his presence and in the presence of each other Subscribed their names respectively thereto as witnesses to the execution thereof. That Since the Execution of Said Will the Said Moses H. White has departed this life. That at the time of the Execution thereof the Said deceased was a citizen of the United States, above the age of twenty one years, of Sound disposing mind and memory and not under restraint to the best of the Knowledge, information & belief of these deponents. Sworn this First day of} Jerome T. Mason October A.D. 1855 before me} D. A. Boies, Surrogate State of New York Washington County SS: Joseph [B??????] of Greenwich in Said Washington County duly sworn in open Court says, that he was acquainted with the within named Henry Stead in his lifetime and with his handwriting and has seen him write & that he verily believes that the Signature "Henry Stead" Signed to the End of the instrument in writing Exhibited to deponent purporting to be the last Will and Testament of the Said deceased is the true and genuine handwriting & signature of the Said Henry Stead deceased. Sworn to before me this} Joseph [B??????] 1st day of October 1855} D. A. Boies, Surrogate State of New York Washington County SS: LeRoy Mowry of Greenwich in Said County being duly Sworn in open Court deposed and Says: that he was acquainted with the within named Moses H White late of Greenwich aforesaid deceased and have seen him write and was acquainted with his handwriting and that he verily believes that the Signature "Moses H. White" signed as a witness to the Will within described and which is Exhibited to deponent is the true and genuine handwriting and Signature of the Said Moses H.
