In the Name of God Amen. I Oliver Colven of the town of Kingsbury in the County of Washington and State of New york considering the uncertainty of this mortal life and being of perfect health and sound memory blessed be almity God for the same do make and publish this my last will and testament in manner and form following, that is tosay. First I give and bequeath unto my beloved wife Elesibath Colven a good horse saddle and bridle, a good Cow and all my household furniture and at hir descease at hir disposial, and further I will to my wife Elesibeth one hundred Dollars per year during her life and one third part of my dwelling House which She chuses during her life-- I do also give & bequeath unto my two [the word "two" is crossed out] grandsons Benjamin C. Pratt, Able Pratt, Nathan Pratt and Oliver C. Pratt the sum of fifty Dollars each to be paid when they become of age, and if any of them should die before they should become of age then to go to the rest---- I also give & bequeath to my daughter Mary High the sum of two hundred and fifty Dollars to be paid in two years after my discease -- I also give & bequeath to my sons William Colven and Obadiah Colven the Sum of one dollar Each whome I appoint sole Executors of this my last will and Testament, the above Legacies I will and order to be paid by my Executors in manner and form as above directed and further that the horse & Cow that is to go to my wife is to be kept during her life by my Executors -- I also give and bequeath all the personal property that I own after paying the above Legacies to my three sons William Colven Obadiah Colven and Hiram Colven equally -- But if there should not be enough of the personal Property to pay my Debts and the above Legacies then my Executors are to sell enough of my Land to make it out-- I further give & devise to my Daughter Mary High hir heirs and assigns all that part of Lot No. ninety two that I own said lot being the Northwest corner lot of the town of Kingsbury to hir to hold hir heirs and assigns forever I further give and devise to my three sons William Colven Obadiah Colven and Hiram Colven their Heirs and assigns all the remainder of my Lands and Tenements of any kind or nature whatsoever to them & their heirs and assigns forever to be devided equally amonst them: and further if Hiram Colven should die without leaving any Heirs then the land to go to William and Obadiah, hereby revoking all former wills by me made-- In witness whereof I have hereunto set my hand and seal this first day of November in the year of our Lord one thousand Eight hundred and two -- --- --- Signed Sealed and declared by the above named Oliver Colven to be his last will and Testament in the presence of us who have here unto subscribed our names as Witness in the presence of the Testator "Note the word "Equally" between lines 31 & 32 } from the top interlined and noted before } execution hereof---------------- } Oliver Colvin L.S. Caleb Baker John Baker James Deen Nathan Mumson County of Washington SS Be it remembered that on the secon[d] day of June in the year of our Lord one thousand eight hundred andthree personally appeared before me Edward Savage Esquire Surroga[te] of the Said County Caleb Baker one of the witnesses to the preceeding will who being duly sworn on his oath declared that he did see Oliver Colven sign and seal the preceeding Instrument purporting to be the last will and Testament of him the said Oliver Colvin bearing date the first day of November one thousand Eight hundred and two and heard him publish and declare the Same as and for his last will and Testament: that at the time thereof he the said Oliver Colvin was of sound disposing mind and memory to the best of the knowledge and beleif of him the Deponent: that his name thereto is of his own proper hand writing which he subscribed as a witness to the said will in the presence of the testator:-- and that he did see John Baker, James Deen & Nathan Mumson subscribe their names as witnesses to the said will in the Testator's presence And be it also remembered that on the Eighth day of June in the year last aforesaid personally appeared before me William Colvin & Obadiah Colvin the Executors in the said will named who were duly sworn to the true execution and performance thereof by taking the oath of Executors as by Law appointed. --- [SIGNED] Edw. .
