Washington County SS: The People of the State of New York by the Grace of God Free and Independent: To all to whom these presents shall come or may concern, Send Greeting. Know Ye: That at Salem, in the County of Washington, on the Nineteenth day of December in the year 1806. Before Edward Savage Esq. Surrogate of our said county, The Last Will and Testament of Burr Stoddard, Deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death Goods, Chattels or Credits within this State by means whereof the proving and registering the said will, and the Granting Administration of all and Singular the said goods, chattels, and credits, and also the auditing, allowing and final discharging the account thereof, doth belong unto us: the administration of all and Singular the Goods, Chattels and Credits of the said deceased and any way concerning his Will is granted unto Sarah Stoddard, Executrix, and Colburn Barrell and Asahel Hodge Junior executors in the said will named they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and Singular the said Goods, Chattels, and Credits and also to render a just and true account thereunto. In Testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed. Witness Edward Savage, Esq., Surrogate of the said County at Salem aforesaid, the Sixth day of January in the year of our Lord one thousand eight hundred and seven and of our Independence the thirty first. Edward Savage, Esq. Copy of the Last Will and Testament of Burr Stoddard (deceased) Recorded Jan 6, 1807 In the name of God, Amen. I Burr Stoddard of Hartford in the County of Washington do make my Last Will and Testament in the manner following. (Viz) First I give and bequeath unto my Beloved Wife Sarah Stoddard all my household furniture except one bed and furniture for the same which I reserve to and for my two sons namely Abijah Stoddard and Daniel Comstock Stoddard in case my said wife should marry before my said two sons but my said wife to have the benefit of the said bed until she doth marry. Secondly, I give unto my two daughters Sophia Cook and Sarah Slocum each a common Bible. Thirdly, I give the remainder of my Estate to my said wife Sarah and my two sons Abijah and Daniel Compstock Stoddard to be legally divided among them during the natural life of my said wife Sarah, and after her death her third part of my said real estate to be divided equally between my said two sons, Abijah and Daniel C. Stoddard. Fourthly, it is my will that Aaron Smith Bateman who was given to me when an infant be returned to his father and be at his disposal and in case his said father should refuse or neglect to receive and take charge of the said Aaron Smith Bateman that my executor should put him an Apprentice to some trade until he shall arrive to the age of Twenty-one years. Lastly, I do appoint my trusty friends Colburn Barrell and Asahel Hodge Junior together with my beloved Wife Sarah Stoddard Executors and Trustees to this my Last Will and Testament. In witness whereof I have hereunto set my hand and seal the seventeenth Day of September in the year of our Lord one thousand Eight hundred and Six. Burr Stoddard Signed Sealed published and declared as and for his Last Will and Testament in our presence who have subscribed the same in the presence of the Testator and Each other. Asahel Hodge Lazarus Barrell David Dewey Washington County, Be it remembered that on the Thirteenth day of December in the year of our Lord one thousand Eight hundred and Six, personally appeared before me Edward Savage one of the Surrogates of said County, Asahel Hodge, one of the subscribing witnesses to the preceding will, and being duly sworn on his oath declared that he did see Burr Stoddard depose, sign and seal the preceding instrument in writing purporting to be the will of Burr Stoddard bearing Date the Seventeenth Day of September in the year of our Lord one thousand Eight hundred and Six; and heard him publish and declare the same as and for his Last Will and Testament. That at the time thereof the said Burr Stoddard was of sound Disposing Mind and Memory, according to the best of the knowledge and belief of him, the deponent. That the name of the deponent subscribed to the said will is of his own handwriting Which he subscribed as witness to the said will in testators presence and that he the Deponent saw Lazarus Barrell and David Dewey the other witnesses subscribe their names as witnesses to the said will in the testators presence. And be it also Remembered that on the same personally appeared before me the said Surrogate Sarah Stoddard the Executrix and Colburn Barrell and Asahel Hodge Junior the Executors in the said Will named and were duly qualified to the True Execution and performance of the said Will by severally taking the Oath of an Executor as by law approved before me.
