NY Vol. 3, page 67 (Washington County Wills Book III p. 67-68 LDS film 0513862) In the name of God Amen. I Joseph Eggleston of the town of Hebron County of Washington & State of New York wheelwright being sick & weak in body but of perfect mind and memory, thanks be given unto God. Calling unto mind the mortability of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament; that is to say principally and first of all I give and recommend my soul unto the hand of Almighty God that gave it and my body I commend to the earth to be buried in decent Christian burial at the discretion of my Executors, nothing doubting but at the grand resurection I shall receive the same by the mighty power of God-and as touching such worldly estate wherewith it has pleased God to bless me in this life I give demise and dispose of the same in the following manner and form. First I give and bequeath to Lucy my dearly beloved wife the third of the profits of my farm during the time she remains my widow but no longer but if she marries I bequeath to her fifty Dollars and no more to be paid out of the of my personal property-also I give and bequeath to my well beloved sons Henry & Joseph two hundred Dollars each to be raised & leved out of my estate. Also I give to my well beloved daughters Lois Jane & Anna Seventy five Dollars each to be raised and leved out of my estate And if Lucy my dearly beloved wife marries forfets her third of the profits of my farm then I give my sons & daughters above mentioned their equal shares of the same in proportion as above stated-also I constitute, make and ordain Henry Matterson, James Carlisle and Charles Allen the sole Executors of this my last will and testament-and I do hereby utterly disallow and disannul all and every other former testaments, wills, legacies, bequests and executors by me in my wife before named wills & bequeaths, ratifying and confirming this and no other to be my last will and testament-In witness whereof I have hereunto set my hand and seal this twenty sixth day of February in the year of our Lord one thousand eight hundred and twelve. Be it remembered that on the twenty seventh day of November in the year of our Lord one thousand eight hundred and twelve personally came & appeared before me Nathaniel Pitcher Esquire, surrogate of the county of Washington Elijah Clough & John Clark who being duly sworn testified that they are two of the subscribing witness to the preceding will and testament of Joseph Eagleston did see the said Joseph Eagleston sign seal publish & declare the foregoing is a copy as and for his last will & testament-that their names thereunto subscribed is of their own hand writing which they subscribed in the (Washington County Wills Book III p. 67-68 LDS film 0513862)
