Hendryxson. In the name of God, Amen: I James T. Hendryxson, of the Town of Kingsbury In the County of Washington, and State of New York, of the age of 55 years, and being of sound mind and memory, do make, publish and declare, this my last Will and Testament, In manner following, that is to say: First, After all my just debts and funeral expenses are fully paid, I give, bequeath and devise to my wife Ellen Hendryxson all my real and personal estate to be used and enjoyed by her as She may elect, giving her the entire con trol to use as She Sees proper, with power to Sell and deed real estate and use the proceeds thereof for her own use and benefit during the term or her natural life, Second. If after the death of my wife, there should be any real or personal estate left of the above, I give, bequeath and devise, all such residue or remainder to my daughter Ida Hubbell of Queensbury, N. Y. and to Carrie Farrell now resid ing in Patterson New Jersey, to be divided equally between them share and share alike. And lastly - I do hereby nominate and appoint my wife Ellen Hendryxson Sole ExecutrIx of this my last Will and Testament hereby revoking all former wills by me made. DeWitt C. Jenkins and Allen Brown whose names are signed to the said Will as witnesses, being each and examined as a witness in the above entitled matter says, and each for himself says:. I was acquainted with the above named James Hendrickson in his lifetime and was present and saw him subscribe his name at the end of the instrument now shown to me offered for Probate as his Last Will and Testament, bearing date the 16th day of February one thousand eight hundred and ninety one. At the time of subscribing his name aforesaid, the said decedent published. and . declared the said instrument to be his Will and. Testa- ment in the presence of myself and of the other subscribing witness above named. I then subscribed my name as a witness to the said instrument, at the request, and In the presence of the said decedent, and of the said other witness, and I saw the said, other witness sign his name: thereto, and know that he did so, at. the request of the said decedent, and in his presence. The said decedent at said time was over the age of twenty-one years, and in my opinion was of sound mind and memory and not under restraint.
