The Last Will & Testament Of John "Pioneer John" Allen 1734   1826

The last Will and Testament of John Allen of White Creek, County of Washington
and State of New York. 

I John Allen considering the uncertainties  of this mortal life and being of
sound mind and memory, blessed be the Almighty for the same, do make and
publish this my last Will and Testament in manner and form following, (that is
to say).

Firstly, I order my Executor whom I shall hereafter name to bury me in decent
burial ground in a decent manner and to pay all my just debts out of his own
or the property that I shall hereafter give him.

Item. I give and bequeath to my beloved son, John, and to his heirs and
assigns forever two certain pieces or parcels or parcels [sic] of land on my
homestead farm that he is now in possetion of. One of the pieces of land is
where his buildings now stand and contains about three acres and one fourth of
land. One other piece or parcel of land lies on the Southerly side of the
highway now in his possetion lying between lands now in the possetion of
Christopher Allen and joins the land that he and Gilbert Allen bought of James
Russell formerly belonged to the heirs of Jonathan Woodard, deceased,
containing about thirteen acres and three fourths of land, and the equal one
half of my wearing apparel freely by him, his heirs, and assigns to be posseed
forever and the other half of my apparel I give to son Gilbert.

Item. I give to my beloved son, Christopher, all the land that he is now in
the possession of on the southerly side of the highway that leads from the
house that he now lives in to Shafsbury leading by Zebulon Cornells now
dividing house and to his heirs and assigns forever freely by him to be
possessed.

Item. I give to my beloved daughters Anna Deuel, Lidia Cross, Elisabeth
Draper, Rhoda Murry & Sarah Richards Fifty dollars each to be paid in two
years after my decease, and to the heirs of my daughter Ruth Allen, deceased,
Fifty dollars to be equally to be divided amongst them   to be pain in two
years after my decease. And the indore movables I give to my daughters Anna
Deuel, Lidia Cross, Elisabeth Draper, Rhoda Murry, Sarah Richards & my
daughter Mary Hendricks & the heirs of my daughter Ruth Allen to be equally
divided among them but it is to be understood on the direction that the heirs
of Ruth is only to come in for the seventh part of said movables.

Item. I give to my grandson, John Hendrick, Fifty Dollars to be paid to him
when he arrives to the age of Twenty one years and to my two granddaughters,
Rhoda Hendricks & Carolina Hendricks, Ten Dollars each to be paid to them when
they arrive to the age of eighteen years and if either of them dies before
they arrive to lawful age I then give their right to their legal heirs to be
paid to them by my Executor whom I shall hereafter name who is directed to pay
all the above legacies as directed above.

Item. I give to my beloved son, Gilbert, all my land in the town of Shafsbury,
County of Bennington and State of Vermont together with all my lands situate,
lying and being on the White Creek being the farm that I live on that is not
give to my sons Christopher & John. Said lands lies northerly and easterly of
the highway leading from White Creek to Shafsbury to him and his heirs and
assigns forever freely by them to be possessed. I further give to my son
Gilbert all my stock and outdore movables and my clock and order him, his
heirs, Executors, & administrators to support and provide for in sickness and
health my son George during his natural life both victuals, clothing, lodging,
and all other things needed for his decent support and to pay all of my just
debts & funeral charges as above and legacies as above directed, and further I
constitute and appoint my son Gilbert my sole Executor of this my last Will
and Testament hereby revoking all former Wills by me made. 

In Witness whereof I have hereunto set my hand and seal this twenty first day
of February on the year of our lord one thousand eight hundred & twenty.
Signed, Sealed, published and declared by the above named John Allen
to be his last Will and Testament in the presence of in who have hereunto
subscribed our names as witnesses on the presents of the testator.
