I Hiram Colvin of the town of Kingsbury County of Washington and State of New York, being weak in body but of sound and perfect mind & memory blessed be almighty God for the same do make and publish this my Last will and testament in manner and form following that is to say -- firstly it is my wishes and my will that my funeral charges, and all be debts be paid. Secondly. I give and bequeath unto my beloved wife Barbary all my household furniture which was given to her by her father -- I also give and bequeath unto my eldest son Olive[r]diah my brass clock. I also give and bequeath unto my two eldest sons Oliverdiah and Oscar all my household furniture which belonged to their mother (now deceased) share and share alike equally to be divided between the two, which said several legacies I will and order shall be paid to the said respective legatees within six months after my decease -- I further give and devise to my beloved wife Barbary in lieu of her right of dower, and to be set off to her at any time hereafter, when she shall demand the same, the use of the one third part of all my real estate during her natural life. but it is my desire, and I do hereby advise and recommend that my said wife do continue to live with and assent in bringing up my family untill the youngest child of my said familee shall arrive to the age of twenty one years. and that my said real estate be all kept together and occupied and improved for the joint benefit of all, unless that my executors which are herein after named should in their judgment otherwise direct. and it is also my desire and wishes that my said son Oliverdiah do after my decease continue to live with and take charge of my said familee by providing for and causing them to be brought up in a proper and becoming manner untill the youngest of them shall arrive to the age of twenty one years. and in case he shall so do and to the best of ability perform this my request, I do hereby as a compensation for such services give and devise to him of my real estate to the value of five hundred dollars to be set off to him at the time. that my youngest child Mary Elizabeth shall arrive to the age of twenty one years And the rest and residue of all my real and personal estate in law and in equity in reversion and remainder , that shall remain at the time my said youngest child Mary Elizabeth shall arrive at the age of twenty one years, I hereby give devise and bequeath, first to my said son Oliverdiah the one sixth part, to my son Oscar one sixth part, to my son Hiram one sixth par[t], to my son Herchall one sixth part, and to my daughter Mary Elizabth one sixth part, or that is to say share and share alike.-- Lastly I do hereby appoint my beloved wife Barbary executrix and my son Oliverdiah and Solomon King executors for this my last will and testament, and I hereby authorize and impowe[r] them or the survivor of them to sell and dispose, at any time after my decease, that they may may deem it for the interest of the heirs so to do, all or any part of my real estate, and to execute in due form of law thereof to a purchaser or purchasers good ample and sufficient deeds of conveyance in the law, and to invest the proceeds of such sale or sale in the purchase of real estate, or each part of proportion thereof as shall belong to minor heirs. hereby revoking all former wills by me made. Washington County } Surrogate office }ss Be it remembered that at a Surrogate Court, held at Kingsbury in the said County on the 10th day of June 1834 before John Willard Surrogate of the said County, on the return of a citation to the next of kin of Hiram Colvin late of the town of Kingsbury in the said County of Washington deceased, duly remanding to law. Harlow Crandell one of the subscribing witnesses to the last will and testament of the said deceased, (a copy of which is hereto annexed) appeared before the Surrogate in open court, and after being duly sworn testified in substance that he was present and saw the said Hiram subscribe his to the said will; that the said Hiram at the same time published and declared it as and for his last will and testament in the presence of the deponent & Alexander Latimer, and that the deponent & the said Alexander, at the request of the said Hiram & in his presence & in the presence of each other, respectively subscribed their names therto as witnesses to the execution thereof: that at the time there of the said Hiram was above the age of twenty one years, of sound disposing mind & memory according to the knowledge & belief of the deponent and not under restraint to the knowledge of the deponent. Whereupon it was ordered by the said Court that the said will be admitted to probate and that letters testamentary then be granted to Barbary Colvin Executrix & Solomon King Executor in the said will named after the expiration of thirty days from the making of the said order on their taking the oath required by law, provided no valid objection thereto is in the mean time exhibited & established -- In testimony whereof the said Surrogate has hereto affixed his seal of office & Subscribed his name this 10th day of June A. D. 1834.
