I, Edward Moss of Kingsbury in the county of Washington and state of New York being weak in body but of perfect mind and memory blessed be God for the same do make and publish this my last Will & Testament in manner following, to wit First It is my will and desire that my funeral charges and just debts be defrayed and paid for that purpose I hereby authorize my executor herein after named to sell and dispose of the whole or any part of my real and personal estate (in his discretion) and to execute all proper deeds and conveyances to any purchaser or purchasers thereof and after the payment of the said debts I give devise and bequeath to my beloved wife Sarah all the rest and residue of my real or personal estate or the avails whereof for her support and maintainance (sp) during her natural life and to enable her as far as practicable to support and educate the children with which God has blessed us but on condition of the intermarriage of my said wife, then and in that case I give devise and bequeath whatever may remain of my said estate real or personal to my children to be divided equally between them share and share alike first regarding in the dividend the amount or value of such articles as I have heretofore given to my daughter Rhoda. Secondly, I hereby appoint my brother in law Thomas A. Sherwood sole executor of this my last Will & Testament and do also by these presents constitute him the guardian of my said children until they respectively arrive at lawful age. In witness whereof, I have hereunto set my hand and seal the second day of February in the year of our Lord one thousand eight hundred & thirty one. Note the words "during her natural life" and "them" first interlined signed published and declared by the above named Edward Moss to be his last Will & Testament in the presence of us who have hereto subscribed our names as witnesses in the presence of the testator and in the presence of each other. s/ Edward Moss s/ Chester Cooke, James Moss, Leonard Cronkhite} all of Kingsbury At a surrogates Court held in the County of Washington on the 3rd day of March 1831 before Samual Standish, Jr. Surrogate of said County for the purpose of proving and knowing?? The Last Will and testament of Edward Moss late of the Town of Kingsbury in the County of Washington deceased in pursuance of Chapter 6th Title 1st Article 1st part Second of the Revised Statutes of the State of New York on the application of Thomas A. Sherwood Executor in the said will named. Thomas A. Sherwood the applicant appeared in person and no one to oppose the applicant proved by the affidavit of Leonard Cronkhite due service of notice on all the kin of Deceased of this intention to prove the said will for recording on this day at 11 o'clock in the forenoon which notice was served on 15th February 1831 and on producing the said will the subscribing witnesses to wit, Chester Cooke, James Moss & Leonard Cronkhite who being duly sworn as required by the said Surrogate testified as follows which was recorded to writing and subscribed by them, to wit: Chester Cooke, James Moss and Leonard Cronkhite of the Town of Kingsbury in the County of Washington and State of New York, being first duly sworn each for himself deposeth and saith that he saw Edward Moss deceased subscribe the instrument now shown to him this deponent and which purports to be the Last Will and testament of the said Edward Moss bearing date the second day of February A.D. 1831. That he heard the said Edward Moss declare the same to be his Last will and testament and that this deponent did subscribe his name thereto as a witness at the request and in the presence of the said Edward Moss and further that at the time thereof the said Edward Moss was of sound mind and memory of full age and not under any restraint.
