David McWhorter is to have his in three years after my decease. My daughter, Martha is to have hers four years after my decease. My son Alexander McWhorter is to have his in five years after my decease. Also, my son Mathew is to take care, provide and maintain for victuals, drink and clothing suitable to his degree my daughter Minerva McWhorter through her natural life, also pay all my lawful debts and personal charges at my death. Lastly, I appoint Sarah McConnel and Abel Wood Executors of this my last Will and Testament hereby revoking all former wills by me made. In witness, whereof I have hereunto set my hand and seal this 10th day of November in the year of our Lord, one thousand eight hundred and thirty-two. Signed, sealed, published and declared by the above named James McWhorter to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator. James Crawford William McKnight Abel Wood Washington Surrogate Court Testimony In the matter of the estate of James McWhorter late of Hebron, deceased, Washington County, NY James Crawford and William McKnight, being duly sworn in open court, do severally depose and say, that they were acquainted with the above named deceased in his life time, and were present and saw him subscribe his name at the end of the instrument in writing now produced and shown to them, and that the said deceased at the same time published and declared the same, as and for, his last will and testament, in the presence of these deponents and Abel Wood, who, at the request of the said deceased, and in his presence, and in the presence of each other, subscribed their names respectively thereof, the said deceased was of sound disposing mind and manner, above the age of twenty one years and under no restraint, to the best of the knowledge and belief of those deponents.
