First; I give and bequeath unto my beloved wife all my household furniture & a maintenance and support at my present place of residence and that my farm shall be holden therefore during her natural life. It is my will that my son David reside on the farm with my wife and provide for her from the avails & profits thereof both in sickness and health, and that the profits of the farm over & above my wife's support shall pay him for his services to my wife. Secondly; I give & bequeath unto my on David one thousand Dollars to be paid to him one year after my decease. Thirdly; I give and bequeath unto each of my daughters, Esther Maria McClellan, Roseamond McClaughey, Loisa Rogers five hundred dollars each, to be paid by my executors hereafter mentioned within one year after my decease. Fourthly; I also give and bequeath unto my grandson Alexander Thompson, five hundred dollars, and appoint his father Isaac Thompson to receive the money & be his guardian till he arrives at the age of twenty one years, my grandson's legacy to be paid within one year after my decease. My personal property shall be disposed of to pay the legacies to my daughters and grandson. After the decease of my wife all my property both personal & real after paying my legacies & debts shall be equally divided among my heirs & grandson. I appoint his father guardian to receive whatever may be coming to him. I hereby constitute & appoint William W. McClellan & Nathaniel Reynolds my executors of this my last will & testament. In witness whereof I have hereinto set my hand & seal this 28th day of November in the year of our Lord one thousand eight hundred and fifty-six. A. McWhorter S.S. This instrument consisting of one sheet was a the time of subscribing declared to us by the testator to be his last will & testament and we at his request sign our names as subscribing or attesting witnesses. The words "six months" "to receive the money" "my" "my" were erased before signing. Testimony County of Washington Surrogate Court For the matter of proving the last Will and Testament Of Alexander McWhorter late of Hebron deceased, Washington County. S.S: Nathaniel Reynolds and Abraham Johnston severally of Hebron in said county; Being first duly sworn in open Court, severally depose and say, that they were acquainted with the above named Alexander McWhorter in his life-time; and that they and each of them were present, and saw him subscribe his name at the end of the instrument in writing now produced and exhibited to them purporting to be the last Will and Testament of the said deceased, bearing date the 28th day of November A.D. 1856. That the said deceased at the time of subscribing his name as aforesaid, published and declared the said instrument to be his last Will and Testament, in the presence of these deponents at the request of the said deceased, and in his presence and in presence of each other, subscribed their names respectively thereto as witnesses to the execution thereof. That at the time of the execution thereof, the said deceased was a citizen of the United States, above the age of twenty-one years, of sound disposing mind and memory, and not under restraint, to the best of the knowledge information and belief of these deponents.
