Stoddard Town of Hampton, Washington County G-327 Transcribed from SAMPUBCO copy In the name of God, Amen. I Joseph M. Stoddard of the town of Hampton in the County of Washington and State of New York being of sound mind and memory do make publish and declare this my last Will and Testament in manner following. First, I give and bequeath to my wife Deborah Ann all my personal and real estate of what nature or kind whatsoever, or wherever situate or being to be used, occupied, and enjoyed by her during the term of her natural life: and from and immediately after her decease I give devise and bequeath the said personal and real estate to my daughter Sarah A. Stoddard and to my son Marvin O. Stoddard to be equally divided between them share and share alike. Lastly, I hereby appoint my said wife Deborah Ann sole executrix of this my last will and testament, hereby revoking all former wills by me made. In writing whereof I have hereunto set my hand and seal this twentieth day of June, one thousand eight hundred and fifty-six. Joseph M. Stoddard as and for his last will and testament, in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto. R. Day, Whitehall, Washington County, NY L.W. Falkenburg, Whitehall, Washington County, NY County of Washington Surrogates Court In the Matter of proving the last will and testament of Joseph M. Stoddard, late of Hampton, deceased, Washington County, ss: Robert Day and Levi W. Falkenburg severally residing in Whitehall in said county, being first duly sworn, in open Court, severally depose and say that they were acquainted with the above named Joseph M. Stoddard in his life time, and that they and each of them were present and saw him subscribe his name at the end of the instrument in writing now produced and exhibited to them purporting to be the last will and testament of the said deceased bearing date the 20th day of June AD 1855. That the said deceased at the time of subscribing his name as aforesaid published and declared the said instrument to be his last will and testament in the presence of these deponents and of each of them, and these deponents at the request of the said deceased and in his presence and in the presence of each other subscribed their names respectively thereto as witnesses to the execution thereof. That at the time of the execution thereof, the said deceased was a citizen of the United States, above the age of twenty one years, of sound disposing mind and memory and not under restraint to the best of the knowledge information and belief of these deponents. Sworn this 5th day of October AD 1857 before me, M. Fairchild, Surrogate R. Day L.W. Falkenburg County of Washington Surrogates Court, ss: I Manning Fairchild Surrogate of said County do hereby certify the forgoing to be a correct record of the last will and testament of Joseph M. Stoddard and late of Hampton in said County, deceased and of the testimony taken by and before me on proving said will as a will of real and personal estate.
