The submittor has given permission to the USGenWeb Archives to store the file permanently for free access. ************************************************************************ Will of Nehemiah Collins (1828 - 9 Aug 1885) I, Nehemiah COLLINS of Whitehall, New York, being of sound mind and memory, do make, ordain, publish and declare this to be my last Will and Testament. That is to say: First. After all my lawful debts are paid and discharged, I give, devise and bequeath to my beloved wife, Maria COLLINS, the sum of three thousand dollars also all any household furniture of every name, nature and description. But said legacy is not to be paid until the sale of the farm by my executors nor any legacy paid until the sale of my farm and property reduced to money as hereafter provided, and is to be in lieu of dower. 2nd. To my daughter Mariam the sum of One Thousand dollars and one cow of her selection. 3rd. To my son Cyrus the sum of one thousand dollars also two horses Joe and Jerry on his paying for said horses the sum of one hundred dollars. 4th. To my daughter Alice the sum of One Thousand Dollars also the black mare Nellie and the harness robe and blanket called hers and one Holstein calf. 5th. To my daughter Eunice the sum of One thousand dollars also one cow and the Horse wagon cutter harness and robes that have been called hers. 6th. To my grand Daughter Lena FISH the sum of Five hundred dollars. 7th. To my Grand son Walter W. COLLINS the sum of Three hundred dollars. 8th. To my son in Law Edwin C. PRATT for his kindness during my sickness the sum of One hundred dollars. 9th. The rest and residue of my estate if any to be divided between Cyrus, Alice, and Eunice, share and share alike. 10th. My son Cyrus to work and carry on my said farm until another spring unless any executors shall have an opportunity of selling said farm to great advantage before then and Cyrus is to be paid for his services in working and arranging said farm the sum of $30 a month until sold and my wife Maria and daughters Alice and Eunice are each respectively to have for their work and service the sum of two dollars per week. 11th. To my son Cyrus all the small carpenter tools upon my said farm and used by me therein until said farm is sold by my executors as hereinafter provided. 12th. All my said property is to remain in said farm. 13th. I hereby authorize and empower my said executors hereinafter named to bargain sell convey and Deed my said farm and any and all real estate I may now own and hereinafter become seized(?) is fully as I might do if living. But it is my desire that my said farm shall not be sold until another spring unless it is clearly for the advantage of my heirs and legaties to sell the same before them trusting any executors will exercise a sound discretion and do what is for the greatest benefit to my estate in case of deficiency each legatee to be paid pro rate. Likewise I make constitute and appoint my son Cyrus COLLINS and my son in Law Edwin C. PRATT to be executors of this my last will and Testament hereby revoking all former wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal the 3oth day of May in the year of our Lord one thousand eight hundred and eighty five.
