That is to say- First After all my lawful debts are paid and discharged, I give and bequeath to my beloved wife and Mother of the residuary legatee hereinafter named; One hundred dollars, and she is to be provided with a good, free and comfortable support during her natural life, wherever she may choose to live, and with whom she may desire to remain and I hereby expressly direct that said provisions in behalf of my said wife are to be in full of and her lieu of dower [sic prob. meant "in full and in lieu of her dower"]; and in case my said wife shall (or will) not accept of the same in lieu of dower, then such provision is to be void, and inoperative as though no provision herein in her behalf had been made. Second I give and bequeath to Myron Wallace Lyon, My grandson, One hundred dollars to be paid to him by my executor herein named when he shall arrive at the age of 21 years. Except that he should become of that age before my decease in which case it is then to be paid within one year from or after my decease. Third I give and bequeath to my daughter Clarissa Smith six hundred ($600.00) Dollars to be paid to her by my said executor, but not until the demise of her Mother, Mary Lyon. Fourth I give and bequeath unto my Daughter Elizabeth Thomas, Wife of Volney Thomas, six hundred ($600.00) Dollars to be paid her in like manner by my said executor after the death of her Mother. Fifth All the rest residue and remainder of my property, both real and personal, I give and bequeath to my son William H Lyon, Absolutely to him, his heirs and assigns, Subject however to the provisions in the first clause of this my said Will mentioned first that in case is Mother accepts of the provisions herein to her in lieu of dower, he is enjoined or bound to give his said Mother a good free and comfortable support during her natural life, wherever she may choose to live & with whom she may desire to remain. And second is hereby required and as executor hereinafter named required to pay out of my estate all just debts & claims against my estate and also all legacies herein provided as directed. It is my desire and wish that my said son Wm H Lyon, enter into full and entire possession of the farm and sole management of my estate for the purpose of carrying out the provisions of this my last Will and Testament, immediately at my death. Sixth Likewise I nominate and appoint William H Lyon aforesaid, sole executor of this my last Will and Testament hereby revoking all former wills by me made. The foregoing instrument, consisting of one sheet, was subscribed by the said Myron Lyon in our presence and acknowledged by him to each of us and he at the same time declared the forgoing instrument so subscribed to his last Will and Testament, and we at his request, in his presence, and in the presence of each other, have signed out names as witnesses hereto, and written opposite our names our respective places of residence. Bliven Kingsbury, NY Surrogates Court Washington County In the matter of Proving the last Will and Testament of Myron Lyon Deceased Washington County ss: George C. Hitchcox & George W. Blivin, each of Kingsbury in said county each being duly sworn in open Court, severally depose & say that they were acquainted with the above named Myron Lyon in his life time; and that they and each of them were present and saw him subscribe his name at the end of the instrument in writing now produced and exhibited to them purporting to be the last Will and Testament of the said deceased. Hearing date the 27th day of March A.D. one thousand eight-hundred and eighty four. That the said deceased at the time of subscribing his name as aforesaid published & declared the said instrument to be his last Will & Testament in the presence of these deponents and each of them; and these deponents, at the request of the said deceased, and in his presence, and in the presence of each other, subscribed their names respectively thereto as witnesses to the execution thereof. That at the time of the execution thereof the said deceased was a citizen of the U.S. above the age of twenty one years, of sound disposing mind, and memory, and not under restraint to the best of the knowledge, information & belief of these deponents.
