This Indenture made the second day of April in the year of our Lord one thousand eight hundred and thirty nine between Jacob P. Garlach of Marion Wayne County New York and Maria his wife of the first part, and Israel Springer of the same place of the second part Witnesseth, the said parties of the first part for and in consideration of the sum of two hundred and fifteen dollars and eighty one cents to them duly paid have sold and by these presents do grant and convey to the said party of the second part, his heirs and assigns all that certain tract or parcel of Land, situate in said town of Marion and is bounded as follows, Beginning Five rods and twenty links east of Nelson Brown barn at astahe and sones thence east twenty four rods and ten links thence north twenty three rods and eight links thence west nineteen rods and six links thence five degrees east seven rods thence west eleven rods and eight links thence south eighteen degrees east seventeen rods and four links to the place of beginning containing four acres fifty rods and six tenths of a rod. The above land is bounded on the north by lands of the Baptist society and Gilbert Gordon on the west by lands of Swan, Waterman Hanks, Solomon West. Martin Moore and the said parties of the first part. With the appurtenances and all the estate rite and interest of the said parties of the first part therein. And the said Jacob P. Garlach for himself his heirs executors or administrators does hereby covenant and agree that at the delivery hereof he is the lawful owner of the premises above granted and seized of a good and indefeasible estate of inheritance therein free and clear of all incumbrances and that he will warrant and defend the above granted premises in the quiet and peaceable possession of the said party of the second part his heirs and assigns forever. In witness whereof the parties of the first part have hereunto set their hands and seals the day and year first above written. Sealed and delivered in presence Jacob P. Garlach and Maria his wife whom I know to be the grantors described in and who executed the above Deed and acknowledged they had executed the same. And the said Maria on a private examination separate and apart from her husband acknowledged she had executed the same freely and without fear or compulsion of her said husband.
