Marion, Wayne County Written: May 19, 1842 Recorded: May 28, 1842 New York, Land Records, Wayne County, Deeds, Volume 31, page 172. This Indenture made this nineteenth day of May one thousand eight hundred and forty two, between Jacob P. Garlach and Maria his wife of the town of Marion county of Wayne and state of New York, of the first part, and William B. Coggshall of the same town of the second part, Witnesseth, that the parties of the first part, in consideration of the sum of Ninety five dollars and sixty two and a half cents to them duly paid have sold and by these presents do grant and convey to the said party of the second part his heirs and assigns all that tract or parcel of land, situate in the said Town of Marion and described as follows, beginning near the south east corner of Land owned by the above named William B. Coggshall thence north on said Coggshall’s east line eleven rods and six links thence east five and a half degrees north seventeen rods and seventeen links thence south two and a half degrees west twelve rods and four links thence west eight and a half degrees north seventeen rods and six links to the place of beginning containing one ace and forty four rods, be the same more or less. With the appurtenances and all the estate title and interest therein of the said parties of the first part. And the said Jacob P. Garlach and Maria his wife do hereby covenant and agree to and with this said party of the second part his heirs and assigns, that the premises thus conveyed in the quiet and peaceable possession of the said party of the second part his heirs and assigns, they will forever Warrant and Defend, against any person whom xxx lawfully claiming the same or any part thereof. In witness whereof the parties of the first part have hereunto set their hands and seals the day and year first above written. Sealed and delivered in presence Of Jacob Heslor Jacob P. Garlach Seal State if New York Maria (her x Mark) Garlach Seal Wayne County ss: On the nineteenth day of May 1842, before me Benjamin B. Durfee a Justice of the peace in and for said county came Jacob P. Garlach and Maria his wife whom I know to be the grantors described in and who executed the above Deed and acknowledged they had executed the same. And the said Maria on a private examination separate and apart from her husband acknowledged she executed the same freely and with fear or compulsion of her said husband. Benjamin B.
