This Indenture, made the fifteenth day of February, in the year of our Lord one thousand eight hundred and thirty Eight, between Jacob Garlock and Maria his wife, of the town of Marion, County of Wayne, and State of New York, of the first part, and Levi Clark, of the same town of the second part, Witness that the said parties of the first part, for and in consideration of the sum of five hundred dollars to them in hand paid by the said party of the second part, the receipt whereof is here by confessed and acknowledged¸have granted bargained sold remised released aliened and confirmed, and by these presents do grant bargain sell remise release alien and confirm unto the said party of the second part, and to his heirs and assigns forever, all that certain land or parcel of land, situate in said town of Marion, and is bounded as follows, vis. Beginning at the northwest corner of land owned by Waterman Hanks, being the same on which he now resides thence north, eighty Eight degrees east, along the line of said Hankses land, five chains to a stake, thence south, seventeen degrees and thirty minutes east, sixty seven links, to a stake, thence south, seventy two degrees and thirty minutes west four chains and Eighty Eight links to a stake, thence northerly, along the line of the highway to the place of beginning; excepting and reserving out of the same thirty eight rods and one half rod in the south west corner of the above described land, which is owned by Alden H. Eddy, containing after deducting the above reservation sixty five rods and one half rod, be the same more or less. Together with all and singular the hereditaments and appurtenances thereto belonging, or in anywise appertaining, and the revenue and revenues remainder and remainders, rents issues and profits thereof; And all the estate right title interest claim and demand whatsoever, of the said parties of the first part, either in law or equity, of in and to the above bargained premises with the said hereditaments and appurtenances: To have and to hold the said premises above described to the said party of the second part his heirs and assigns, to the sole and only proper use benefit and behoof of the said party of the second part his heirs and assigns forever. And the said Jacob Garlock, for himself his heirs executors and administrators do convent grant bargain and agree to and with the said party of the second part , his heirs and assigns that at the time of the emealing and delivery of these presents he was well seised of the premises above conveyed, or of a good sure perfect and indefeasible estate of inheritance in the law in fee simple. And that the above bargained premises ,in the quiet and peaceable possession of the said party of the second part, his heirs and assigns against all and every person or persons lawfully claiming or to clam the whole or any part thereof he will forever warrant and defend. In witness whereof the parties of the first part have hereunto set their hands and seals the day and year first above written. Maris (her +mark) Garlock seal State of New York Wayne County ss: On the fifteenth day of February, in the year 1838, before me the undersigned a Judge in and for said County, came Jacob Garlock and Maria his wife, whom I know to be the grantors described in and who executed the above deed, and acknowledged they had executed the same. And the said Maria on a private examination separate and apart from her husband, acknowledged she executed the same freely and without fear or compulsion of her husband. Marvin Rich.
