This Indenture made the twenty third day of March in the year of our Lord, one Thousand eight hundred and thirty five, between Martin Moore and Joann his wife of the town of Marion, in the County of Wayne, and State of New York, of the first part, and Jacob P. Garlock of the said town County and State aforesaid of the second part, Witnesseth, that the said parties of the first part, for and in consideration of the sum of two thousand dollars, lawful money of the United States of American in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, hath granted bargained sold remissed released aliened and confirmed, and by these presents do grant bargain sell release alien and confirm, unto the said party of the second part, his heirs and assigns forever, all that certain tract or parcel of land, situate in the town of Marion, County of Wayne and State of New York, it being a part of lot number two, in the third range of lots in township number thirteen, in the second range of township and bounded as follows (to wit) beginning at the northwest corner on the line between lot number two and three, at the fork of the highway, near Samuel Eddy’s dwelling house, thence running south Eighty nine degrees and thirty minutes east, twenty seven chains and forty one links to a stake, thence south two degrees and eighteen minutes east, twenty six chains and thirty seven links to a post, thence north eighty nine degrees and thirty minutes west, seventeen chains and fifty links, along the north line of Joseph Caldwells land to a post, in the highway, thence running along the middle of the highway and xxxxxx to the place of beginning, containing sixty two acres and one half acre of land, be the same more or less, as surveyed by John Galispee, reserving always therefrom two pieces of land deeded to Archer Galloway, one piece deeded to Waterman Hawk, and one peace deeded to Joseph C. Moore, in all about five acres be the same more or less, reference being had to his said deed. The above described premasis conveyed subject to a mortgage of six hundred and thirty dollars and the interest by the aforesaid Martin Moore to Samuel Moore, date October second 1834. Together with all and singular the hereditaments and appertenance, thereunto belonging or in any wise appertaining, and the revenue and revenues, remainder and remainders, rents issues and profit, thereof; and all the estate right title interest claim and demand whatsoever, of the said parties of the first part, either in law or equity, of in and too the above bargained premises, with the said heraditaments and appertenances. To have and to hold the said premasis above described to the said party of second part his heirs and assigns to the sole and only proper use, benefit and behoof of the said party of the second part, his heirs and assigns forever. And the said parties of the first part, for themselves their heirs executors and administrators do covenant grant bargain and agree to and with the said party of the second part, his heirs and assigns that at the tie of the creating and delivery of these presents, they were well seised of the premises above conveyed an of a good sure perfect absolute and indefeasible estate of inheritance in the law in fee simple. And that the above bargained premasis, in the quiet and peasible possession of the said party of the second part, his heirs and assigns, against all and every person or persons lawfully claiming or to claim the whole or any part thereof he the said martin Moore will forever warrant and defend in witness whereof the parties of the first part have hereunto set their hands and seals, the day and year first above written.
